Terms & conditions :- 1. The work will be executed in accordance with the provisions contained in form MW4 and as per Punjab PWD specifications. 2 Sales Tax, Income Tax and other levies will be deducted from the contractor's bill as per rules and if any other type of Tax exists/imposed by the Govt. the same will be borne by the agency. 3 (I) In case of any dispute or disagreement arising out of contract agreement Commissioner, Municipal Corporation Ludhiana shall be the Arbitrator, whose decision shall be final and binding upon both the parties. (ii) It shall be an essential terms of this contract that in order to avoid frivolous claims, the party invoking arbitration shall specify the disputes based on facts and calculation stating the amount claimed under each claim and shall furnish in call deposit for ten percent of the amount claimed, on ascheduled bank in the name of the arbitrator by his official designation who shall keep the amount in deposit till the announcement of the award. In the event of an award in favour of the claimant, the deposit shall be refunded to him in proporation to the amount awarded with respect to the amount claimed and the balance, if any, shall be forfeited and paid to the other party. 4 Substandard materials will be rejected and shall not be payable. 5 For the supply items the Goods bearing the ISI mark or the approved make.will be the minimum standard and F.O.R. shall be at MCL. 6 Payment will not be made more than overall saving quoted. 7 Free Of Cost items if quoted shall be adjusted first or proportionally as desired by the Engineer Incharge. 8 The contractor must have GST Registration Number issued by Department of Excise and taxation for the works more than 5 Lacs. 9 The firm should have to offer inspection of materi l at factory premises. The inspection will be carried out by a team comprising of the Executive Engineer-In- Charge of work or any of his representative along with a third consultant. All charges for travel, boarding, lodging etc for inspection team shall be borne by the contractor. 10 All running payments shall be considered as advance payments to the contractors and any excess payment in running bills shall be recovred from the contractor's in final bill. 11 The contractor shall take all measures for the saf ty of traffic during construction and provide erect and maintain such barricades including s gns, markings, flags, lights and flagman as are necessary at either end of excavation/embankment and such intermediate points as directed by Engineer-in-charge for the proper identification of construction area. The firm shall be responsible for all damages and accidents caused due to negligence on his part. Nothing extra shall be payable on this account. The Engineer-incharge will assist the contractor for diverting the traffic with help of local police. 12 The temporary warning lamps shall be installed at the barricades during the hours of darkness and kept lit all times during these hours. 13 The contractor or his authorized representative should always be available at the site of work to take instructions from the department officers and ensure proper execution of work. No work should be done in the absence of such authorized representative. 14 Any material left at site one month after completion of work shall become the property of department and no payment shall be made to the contractor for the material. 15 Contractor is not at liberty to remove from site of work any material which has been issued to him for use on the work without written permission of the Engineer- incharge. 16 The contractor must have EPF registration number and ESI & EPF will be the responsibility of the tenderer. 17 The penalty shall be imposed as per MW4 after expiry of time limit. 18 That In case of any mishap during execution of work, it shall be liability/responsibility of the contractor. 19 The payment
