Description Terms Of Reference Procurement Of Enzyme-linked Immunosorbent Assay (elisa) Racing Kits And Reagents For The Drug Screening Of The Equine Drug Testing Program I. Project Description The Project Aims To Conduct The Procurement For The Supply And Delivery Of Enzyme-linked Immunosorbent Assay (elisa) Racing Kits And Reagents Necessary For The Continuous Operation Of The Equine Drug Testing Program Of The Philippine Racing Commission. Ii. Background It Is The Main Aspiration Of Every Racing And Breeding Authority To Absolutely Protect The Integrity Of Horse Racing. One Of The Means To Achieve This Is Through Screening And Controlling The Use Of Substances Capable Of Giving A Horse An Advantage Or Being Disadvantaged In A Race Contrary To The Horse’s Inherent Merits (iabrw, Ifha 2019). This Will Also Contribute To The True Development Of The Breed And Protect The Welfare Of Trainers, Riders, Other Direct Participants And Most Especially The Horse Itself. The Interest Of The Race Going Public Shall Be Likewise Safeguarded With The Belief That They Are Wagering Or Betting On The Horses With Their True Capabilities And Potential. Several Consultative Meetings Conducted With The Industry Stakeholders Showed That It Is About Time For The Re-implementation Of The Drug Testing Program For The Local Horseracing Industry. Among The Countries In Asia That Conduct The Sports Of Horse Racing, The Philippines Has Long Suspended The Screening And Monitoring Of Illegal And Controlled Substances Used In Racehorses. The Use Of Chemicals Or Drugs Either To Intentionally Lose A Race Or Mask The Pain Or Lameness Of A Horse Is Detrimental To Its Health And Welfare. It Also Poses Danger To The Riders And Misleading The Betting Public Not Knowing That The Horse They Are Betting On Is Not Fully Capable Of Getting The Best Chance Of Winning The Race. Reimplementation Of The Program Has Been Long Delayed Due To The Lack Of A Facility Specifically Intended For Racehorses Thus The Establishment Of The Drug Testing Laboratory As Part Of The Equine Laboratory And Diagnostic Section (elds) In Carmona, Cavite. As For Testing, The Procedure Is Divided Into Two Parts – Screening And Confirmatory. The Laboratory Screens The Samples For The Possible Presence Of The Drug, And In Case The Result Is Positive, A More Sophisticated Method Confirms The Result. Elds Procured The Enzyme-linked Immunosorbent Assay (elisa) Machine Last Year And Still Needs To Procure Supplies Such As Elisa Racing Kits And Reagents For Screening Methods For The Continuous Operation Of The Drug Testing Program. Iii. Approved Budget For The Contract (abc) The Approved Budget For The Contract Is Two Hundred Twenty Two Thousand Pesos And 00/100 (php 222,000.00) Inclusive Of All Applicable Government Taxes, Charges, And Fees. Iv. Mode Of Procurement The Procurement Shall Be Undertaken Through Negotiated Procurement (small Value Procurement) Under The 2016 Revised Implementing Rules And Regulations (irr) Of Republic Act (ra) 9184, Otherwise Known As The “government Procurement Reform Act”. V. Qualifications Of The Supplier A. The Supplier Must Be Operating In The Philippines For At Least Three (3) Years And Registered With The Securities And Exchange Commission Or Department Of Trade And Industry. B. The Supplier Must Be Philgeps Registered. Vi. Schedule Of Requirements A. Delivery Address: Philippine Racing Commission – Equine Laboratory And Diagnostic Center, L1 B18 Contempreto Bldg., Sugar Rd., Brgy. Mabuhay, Carmona, Cavite. B. Delivery Schedule: Sixty (60) Days Upon Receipt Of The Notice To Proceed. Viii. Payment Payment Shall Be Made Within Fifteen (15) Days Upon Delivery Of All The Items In Accordance With The Delivery Schedule And Certified By The End User Through A Certificate Of Completion And Acceptance, And Submission Of Billing Statement. Ix. Liquidated Damages A. When The Supplier Fails To Satisfactorily Deliver Goods Under The Contract Within The Specified Delivery Schedule, Inclusive Of Duly Granted Time Extensions, If Any, The Supplier Shall Be Liable For Damages For The Delay And Shall Pay The Procuring Entity Liquidated Damages, Not By Way Of Penalty, An Amount Equal To One-tenth (1/10) Of One Percent (1%) Of The Cost Of The Delayed Goods Scheduled For Delivery For Every Day Of Delay Until Such Goods Are Finally Delivered And Accepted By Philracom. B. Philracom Need Not Prove That It Has Incurred Actual Damages To Be Entitled To Liquidated Damages. Such Amount Shall Be Deducted From Any Money Due Or Which May Become Due To The Supplier, Or Collected From Any Securities Or Warranties Posted By The Supplier, Whichever Is Convenient To The Procuring Entity Concerned. C. In Case The Total Sum Of Liquidated Damages Reaches Ten Percent (10%) Of The Total Contract Price, Philracom May Rescind The Contract And Impose Appropriate Sanctions Over And Above The Liquidated Damages To Be Paid. X. Right To Accept Or Reject Quotation And/or Annul The Procurement Process Philracom Reserves The Right To Accept Or Reject Any Quotation, To Annul The Procurement Process, Or Not To Award The Contract Without Thereby Incurring Any Liability To The Affected Bidder Or Bidders. Xi. Conformance With The Existing Laws The Procurement Process For This Undertaking Shall Be Executed In Accordance With Republic Act 9184, Otherwise Known As The Government Procurement Reform Act, And Its Revised Implementing Rules And Regulations.
