Description Terms Of Reference Supply And Delivery Of Heavy-duty Overhead Scanner For The Digitization Program I. Objective And Rationale Considering That Philippine Racing Commission Is Starting To Digitize Its Records, New Equipment Must Be Acquired In Order For The Office To Complete The Job Efficiently. Some Of The Documents And Records The Office Currently Uses Are Incompatible With The Market’s Conventional Scanner. Investing In An Overhead Scanner Will Expedite The Process Of Digitalization. Ii. Project Description This Project Intends To Find A Reputable And Competent Product Supplier That Can Supply And Deliver Heavy-duty Overhead Scanners That Conforms With The Specifications Enumerated Below At The Lowest Cost. Iii. Approved Budget For Contract (abc) The Fund For This Project Shall Be Sourced From The Capital Outlay. The Abc Of The Proposed Undertaking Is One Hundred Fifty Thousand Pesos Only (php 150,000.00), Inclusive Of All The Applicable Government Taxes And Charges And Professional Fees. Iv. Mode Of Procurement The Procurement Shall Be Undertaken Through Negotiated Procurement (small Value Procurement) Under The 2016 Revised Implementing Rules And Regulations (irr) Of Republic Act (ra) 9184, Otherwise Known As The “government Procurement Reform Act”. V. Qualification Of The Supplier A. The Supplier Must Have An Updated Business/mayor’s Permit And Dti/sec Registration. B. The Supplier Must Be Philgeps Registered. Vi. Image Processing Functions: Deskew By Text On Document, Automatic Size Detection, Automatic Rotation, Automatic Color Detection, Book Image Correction, Multiple Document Detection B. The Supplier Shall Provide A Product Demonstration. C. The Supplier Must Provide One (1) Year Warranty On Parts And Services. Vii. Schedule Of Requirements A. Delivery Address: Philippine Racing Commission, 4f Electra House Bldg., Esteban St., Legaspi Village, Makati City B. Delivery Schedule: Within Thirty (30) Days Upon Receipt Of Notice To Proceed. Viii. Responsibilities Of The Supplier A. The Supplier Must Deliver The Overhead Scanners In Accordance With The Technical Requirements Required By The Philracom. B. The Supplier Must Deliver The Required Overhead Scanners Following The Delivery Schedule Specified In This Document. Ix. Payment A. Payment Shall Be Made Upon Delivery Of Overhead Scanners In Accordance With The Delivery Schedule Duly Certified And Accepted By The End User. B. Payment Shall Be Made Within Fifteen (15) Days After Submission Of The Delivery Receipt And Sales Invoice. X. Liquidated Damages A. When The Supplier Fails To Satisfactorily Deliver Goods Under The Contract Within The Specified Delivery Schedule, Inclusive Of Duly Granted Time Extensions, If Any, The Supplier Shall Be Liable For Damages For The Delay And Shall Pay The Procuring Entity Liquidated Damages, Not By Way Of Penalty, An Amount Equal To One-tenth (1/10) Of One Percent (1%) Of The Cost Of The Delayed Goods Scheduled For Delivery For Every Day Of Delay Until Such Goods Are Finally Delivered And Accepted By Philracom. B. Philracom Need Not Prove That It Has Incurred Actual Damages To Be Entitled To Liquidated Damages. Such Amount Shall Be Deducted From Any Money Due Or Which May Become Due To The Supplier, Or Collected From Any Securities Or Warranties Posted By The Supplier, Whichever Is Convenient To The Procuring Entity Concerned. C. In Case The Total Sum Of Liquidated Damages Reaches Ten Percent (10%) Of The Total Contract Price, Philracom May Rescind The Contract And Impose Appropriate Sanctions Over And Above The Liquidated Damages To Be Paid. Xi. Right To Accept Or Reject Quotation And/or Annul The Procurement Process Philracom Reserves The Right To Accept Or Reject Any Quotation, To Annul The Procurement Process, Or Not To Award The Contract Without Thereby Incurring Any Liability To The Affected Bidder Or Bidders. Xii. Conformance With The Existing Laws The Procurement Process For This Undertaking Shall Be Executed In Accordance With Republic Act 9184, Otherwise Known As The Government Procurement Reform Act, And Its Revised Implementing Rules And Regulations.
