Description Terms Of Reference For Driving Services Cy 2025 (january To December 2025) I. Background The Department Of Agrarian Reform Province Of Aklan Is In Need Of A Contractor, To Be Hereinafter Referred To As The “agency”, To Provide One (1) Driver To Perform Driving Services For It Office Located At Arcada Prime, Corner M. Laserna And G. Ramos Sts., Kalibo, Aklan. Ii. Specific Provisions 1. The Agency Shall Provide The Department Of Agrarian Reform-province Of Aklan With Competent, Well Trained, Courteous And Licensed Driver. In Addition To The Foregoing, The Driver Employed By The Agency Shall Possess The Following Qualifications: A. Must Be Of Good Moral Character, Without Criminal And/or Police Records. The Driver Shall Be Provided By The Agency With Complete Uniform And Proper Training; B. Must Be Physically And Mentally Fit, As Evidenced By A Medical Certificate Duly Issued By A Reputable Medical Service Agency; C. Must Submit Relevant Documents To Prove That They Are Legitimate Employee Of The Agency. D. Any Misrepresentation By The Agency With Respect To The Above Qualifications Shall Be A Ground For The Termination/ Revocation Of The Contract; 2. The Agency Shall Provide The Driver With Identification Card. Said Driver Shall At All Times Be Subject To Monitoring And Inspection By The Agency And Darpo Aklan. The Agency Shall Provide Darpo Aklan With An Updated List Of Driver Assigned Thereat. 3. The Agency Shall See To It That The Driver Provided Have A Valid Driver's License. The Dar Shall Not Be Responsible For The Renewal Of The Driver's License During The Duration Of Contract. Non-renewal By His Driver's License Shall Be Construed As He Has No Valid Driver's License Which Shall Be A Ground For The Automatic Rescission Of This Contract. 4. The Agency Shall Pay The Wages, Salaries Or Compensation Of The Driver In Accordance With The Provisions Of The Minimum Wage Law And Existing Wage Order As May Be Determined From Time To Time By The Regional Tripartite Wages And Productivity Board. The Payment Shall Be Made Even If, For Some Reason Or The Other, The Agency Fails To Collect On Time From Darpo-aklan. 5. The Agency Hereby Acknowledges The Non-existence Of Principal-agengy Relationship Between Itself And Darpo Aklan. Each Person Or Persons Employed Or Utilized Bt The Agency In Carrying Out This Contract Shall Be The Sole And Exclusive Liability Of The Agency. Darpo Aklan Shall Not Be Responsible Whatsoever For Any Claim Or Claims For Personal Injury, Wages, Damages, Including Death, Caused To Its Personnel Or Third Persons, Where Such Injury Or Death Arises Out Of, Or In The Course Of The Performance Of Their Duties. The Agency Holds Darpo Aklan Free From Any Claim Or Liability For Its Drivers; 6. The Driver Shall Use The Vehicle Of Darpo Aklan During The Length Of This Contract. Driver Assigned To Such Vehicle Shall Be Responsible For The Cleanliness, Worthiness And Running Capacity Of The Vehicle; 7. The Driver Found To Be Undesirable By Darpo Aklan Shall Be Immediately Replaced By The Agency Upon Written Request Hy The Head Of Office Or His/her Duly Authorized Representative; 8. Darpo Aklan Reserves The Right To Decrease And Ot To Increase The Number Of Drivers As Stipulated In This Tor During The Length Of This Contract; 9. The Driver Assigned Shall Not Use Darpo Aklan Property Without Authority From The Management. In Case Of Loss Or Damage Incurred To Such Property, The Driver Concerned Shall Be Presumed To Be Liable Unless He Can Show Proof To The Contrary. In Case Of Disagreement Or Controversy As To The Restitution Of Any Lost, Damaged Or Destroyed Darpo Aklan Property Including Liability To Third Person, With Or Without Negligence On The Part Of The Driver, Both Parties Agree To Create A Committee Which Shall Have The Authority To Determine The Liability Of The Parties To Be Composed Of Two (2) Officials From Darpo Aklan To Be Designated By The Head Of Office And (2) From The Agency. The Coa Resident Auditor Shall Act As The Chairperson Of The Committee. The Decision Of The Committee Shall Be Final And Executory. After The Driver Is Determined To Be At Fault, The Agency Shall Immediately Reimburse Darpo Aklan, The Cost Of The Lost, Damged Or Destroyed Government’s Property. In Case This Arrangement Is Not Complied With, Darpo Aklan Shall Have The Authority To Deduct The Amount From The Agency’s Billing; A. Scope Of Service The Following Is The Scope Of Services That The Agency Shall Provide To Darpo Aklan: 1. The Agency Shall Provide Darpo Aklan With One (1) Driver To Perform Driving Services/transportation Of Goods On Specified Hours As The Darpo Aklan Requires; 2. That The Driver Shall Utilize The Vehicle Owned By The Darpo Aklan Or Any Vehicle That For Some Reaon Will Be Rented By The Latter, Subject To Such Terms And Condition That May Be Agreed Upon In Car Rental Agreement; 3. That The Driver Shall Safety Transport Dar Officials And Employees, Including Guests And Persons Who Have Official Business With Darpo-aklan; 4. The The Driver, In Addition To The Code Of Conduct Prescribed By The Agency, Shall Follow The Rules And Regulations Which Darpo Aklan May Provide, A Copy Of The Guidelines, Rules And Regulations Shall Be Furnished In Writing To The Agency And To The Driver Concerned; 5. That The Agency Shall, Upon Written Request By Darpo Aklan To Replace The Driver Due To Loss Of Confidence Or Improper Conduct; 6. That The Driver May Called Upon When The Need Arises Or In Case Of Emergency To Render Service With Compensation. The Agency Shall Provide A Mandatory Replacement In Case Of Absence Or Sick Leave By The Assigned Driver; 7. That The Driver Must Have At Least Five (5) Years Driving Experience Plying The Route Of Panay Island Including The Negros Provinces And At Least One (1) Year Experience Plying The Route Of Metro Manila And Outside The Province Or Region Vi; 8. That The Driver Must Exercise Utmost Diligence In The Conduct Of Its Passengers And Cargo And Shall Observe Proper Observance Of Traffic Rules And Regulations Enforced By The Land Transportation Office And Related Ordinances Of Local Government Units; 9. The Driver Must Have The Basic Knowledge In Vehicle Repairs Which Includes Changing Of Tires, Oiling Of Nuts And Bolts, Basic Knowledge In Electricity Wiring Of The Head Lights, Signal Lights And Stop Lights; 10. That The Driver Should Monitor The Vehicle Assigned To Him From Time To Time To Avoid The Breakdown Of The Engine And Other Motor Parts. He Must Report At Once To Darpo Aklan Any Part Of The Vehicle That Has Depreciated/destroyed For Replacement; 11. That The Driver Must Strictly Comply With The Documentary Requirements For Travel Including The Preparation Of Trip Ticket And Gasoline Issuance Voucher (giv) Provided By Darpo-aklan. Documents Shall Indicate The Number And Names Of Passengers As Well As The Provision For Fuel To Be Used During The Travel. 12. That In Case Of Accident, The Driver Should Immediately Report The Same To The Nearest Police Station, To Darpo Aklan And To The Agency. B. Medical And Risk Insurance The Agency Shall Subject The Driver To Medical And Risk Insurance Including Third Party Liability. Failure On The Part Of The Agency To Comply With This Requirement Shall Be A Ground For The Rescission Of The Contract. C. Contract Duration The Contract Shall Be For A Term Of One (1) Year Commencing Upon Receipt Of Notice To Proceed. Its Renewal Shall Be Subject To The Result Of The Annual Performance Evaluation To Be Conducted By Darpo Aklan. Should The Agency Fails To Maintain A Satisfactory Performance Based On The Set Of Performance Criteria As Herein Stated Below, Darpo Aklan May Pre-terminate The Contract For Failure By The Agency To Perform Its Obligation. The Performance Criteria To Be Applied Shall Be The Following:  Quality Of Service Delivered – 20%  Time Management – 20%  Management & Suitability Of Personnel – 20%  Contract Administration And Management, And – 20%  Provision Of Regular Progress Reports – 20% D. Approved Budget For The Contract (abc) The Approved Budget Cost Of The Contract Is Two Hundred Twenty-six Thousand One Hundred Sixty-one Pesos (php 226,161.00) For One (1) Year, January 1, 2025 To December 31, 2025. In Accordance With Clause 5.0 Of Appendix 14 Of Gppb Resolution 03-2011 Dated January 28, 2011, All Bid Prices For A Duration Of One (1) Year Shall Be Fixed And Shall Not Be Adjusted During The Contract Implementation, Except For The Following: 1. Increase In The Daily Minimum Wage Pursuant To Law Or New Wage Order Issue After Date Of Bidding; 2. Increase In Taxes; 3. If During The Term Of The Contract, Darpo Aklan Sees The Need For A Decrease In The Number Of Driver; E. Manner Of Payment A. That The Contract Price Of The Driver Is Eighteen Thousand Eight Hundred Forty-six Pesos And Sixty-nine Centavos (php 18,846.69) To Be Paid By Darpo Aklan On A Monthly Basis; B. That Darpo Aklan Shall Be Responsible For The Withholding Of Taxes; C. The Agency Should Comply With The Existing Minimum Wage Law As Well As The Payment Of 13th Month Pay, Service Incentive Leave, Uniform Allowance, Sss Premium, Philhealth Insurance And Pag-ibig Fund To Its Assigned Driver Without Additional Cost To The Darpo-aklan. D. The Payment Will Be Paid/released To The Agency On A Monthly Basis Through The Lddap.
