Description Terms Of Reference For Security Services Cy 2025 (january To December 2025) A. Background The Department Of Agrarian Reform Province Of Aklan Is In Need Of A Contractor, Hereinafter Referred To As The “agency” To Provide Security Services To Its Office At 2nd Floor, Arcada Prime, Corner M. Laserna And G. Ramos Sts., Poblacion, Kalibo, Aklan. B. Specific Provisions 1. The Security Agency Shall Provide The Department Of Agrarian Reform – Province Of Aklan With Competent, Well-trained, Courteous And Licensed Security Guards. In Addition To The Foregoing, The Security Guards Employed By The Agency Shall Possess The Following Qualifications: A. Must Be Of Good Moral Character, Without Criminal And/or Police Records; B. Must Be Physically And Mentally Fit, As Evidenced By A Medical Certificate Issued By A Reputable Medical Service Agency; C. Must Submit Relevant Documents To Prove That They Are Legitimate Employees Of The Agency. Any Misrepresentation By The Agency With Respect To The Above Qualifications Shall Be A Ground For The Termination/revocation Of The Contract; 2. The Agency Shall Provide Their Security Guards With Complete Uniform, Identification Cards, Pistols And Ammunitions, Safety Kit And Proper Training. Said Security Guards Shall At All Times Be Subject To Monitoring And Inspection By The Agency As Well As Evaluation By Darpo-aklan. The Agency Shall Provide Darpo-aklan With An Updated List Of Security Guards Assigned Thereat; 3. The Agency Shall Pay The Wages, Salaries Or Compensation Of The Security Guards In Accordance With The Provisions Of The Minimum Wage Law And In Accordance With The Labor Code Of The Philippines, Including Wage Order As May Be Determined From Time To Time By The Regional Tripartite Wages And Productivity Board. The Payment Shall Be Made Even If, For Some Reason Or The Other, The Agency Fails To Collect On Time From Darpo Aklan; 4. The Agency Hereby Acknowledges The Non-existence Of Principal-agent Relationship Between Darpo Aklan And The Agency. It Is Understood That Each Person Or Persons Employed Or Utilized By The Agency In Carrying Out The Security Services Shall Be The Exclusive Liability Of The Agency. Darpo Aklan Shall Not Be Responsible Whatsoever For Any Claim Or Claims For Personal Injury, Wages, Damages, Including Death, Caused To Its Personnel Or Third Persons, Where Such Injury Or Death Arises Out Of, Or In The Course Of The Performance Of Their Duties; 5. That The Agency Or Security Guards Shall Not Use Office Equipment And Supplies Without The Express Consent Of The Head Of Office Of Darpo Aklan; 6. Any Security Guard Found To Be Undesirable By Darpo Aklan Shall Be Immediately Replaced By The Agency Upon Written Request By The Head Of Office Or His/her Duly Authorized Representative; 7. Darpo Aklan Reserves The Right To Decrease And Or To Increase During The Duration Of The Contract The Number Of Security Guards Stipulated In This Terms Of Reference; 8. In Case Of Disagreement Or Controversy As To The Restitution Of Any Lost, Damaged Or Destroyed Property Of Darpo Aklan, Including The Liability To Third Person, With Or Without Negligence On The Part Of The Security Guards Concerned, Both Parties Agree To Create A Committee Which Shall Investigate And Determine The Liability Of The Parties To Be Composed Of Two (2) Officials From Darpo Aklan To Be Designated By The Head Of Office And Two (2) From The Agency. The Coa Resident Auditor Shall Act As The Chairperson Of The Committee. The Decision Of The Committee Shall Be Final And Executory. After The Agency Is Determined To Be At Fault, It Shall Immediately Pay Darpo Aklan, The Cost Of The Property, Otherwise, The Latter Shall Withhold The Amount From The Agency's Billing. In Relation To All Specific Provisions Stated Primarily To Comply With Republic Act 11917: “an Act Strengthening The Regulation Of The Private Security Services Industry, Repealing For The Purpose, Republic Act No. 5487, Entitled “an Act To Regulate The Organization And Operation Of Private Detective, Watchmen Or Security Guard Agencies”, As Amended.” C. Scope Of Services The Following Are The Scope Of Services That The Agency Shall Provide To Darpo-aklan: 1. The Agency Shall Provide Darpo Aklan With Three (3) Licensed Security Guards Who Are Of Good Moral Character, Well Mannered,trained And Uniformed To Perform Guard-duties On Specified Hours, As The Darpo Aklan Requires. 2. That The Agency Shall Provide Operational Service Firearms And Ammunitions To The Assigned Guards Which Should Be Periodically Fired And Tested And A Metal Detector. The Assigned Guards Shall Be Issued One Side Arm And Long Arm By The Agency. 3. That The Guards Provided By The Agency Must Follow The Rules And Regulations Which The Darpo-aklan May Furnish In Writing. 4. That The Agency Shall Replace Any And/or All Security Personnel, Upon Request By Darpo Aklan, Due To Loss Of Trust And Confidence. 5. That The Security Guard Shall Take Charge Of His Post And All Darpo Aklan Properties In View And Protect/preserve The Same With Utmost Diligence. 6. That The Security Guard Should Walk In An Alert Manner During His Tour Of Duty, Keeping Always On The Alert And Observing Everything That Takes Place Within Sight Or Hearing. 7. That The Security Guard Should Report To Proper Authority All Violations Of Orders Where Darpo Akan Instructed To Enforce. 8. That The Security Guard Shall Not Quit In His Post Until When Properly Relieved. 9. That The Security Guard On Duty Shall Receive, Obey, And Pass On To The Reliever All Orders From Darpo Aklan Officers Or Officials, Supervisors, Post-in-charge Or Shift Leaders. 10. That The Security Guard Shall Not Talk To Other Persons Except In Line Of Duty. 11. That The Security Guard Shall Give The Alarm In Case Of Fire Or Disorder. 12. That The Security Guard Shall Call The Superior Officer In Any Case Not Covered By Instructions. 13. That The Security Guards Shall Salute To Darpo Aklan Officials, Superiors In The Agency, Ranking Public Officials And Officers Of The Philippine National Police. 14. That The Security Guards Shall Be Vigilant Especially At Night And Confront Persons Near His Post, And To Allow No One To Pass Or Loiter Without Proper Authority. D. Medical And Risk Insurance The Contractor Shall Subject The Security Guards To Medical And Risk Insurance. Failure To Comply With This Requirement Shall Be A Ground For The Termination Of Contract. E. Contract Duration The Contract Shall Be For A Term Of One (1) Year Commencing Upon Receipt Of Notice To Proceed, Its Renewal Shall Be Subject To The Result Of The Annual Performance Evaluation To Be Conducted By Darpo Aklan Should The Contractor Fails To Maintain A Satisfactory Performance Based On The Set Of Performance Criteria As Herein Stated Below. The Performance Criteria To Be Applied Shall Be The Following:  Quality Of Service Delivered – 20%  Time Management – 20%  Management & Suitability Of Personnel – 20%  Contract Administration And Management, And – 20%  Provision Of Regular Progress Reports – 20% F. Approved Budget For The Contract (abc) The Approved Budget Cost Of The Contract Is Nine Hundred Twenty Thousand Four Hundred Twenty-four Pesos (p 920,424.00) For One (1) Year, January 1, 2025 To December 31, 2025. In Accordance With Clause 5.0 Of Appendix 14 Of Gppb Resolution 03-2011 Dated January 28, 2011, All Bid Prices For A Duration Of One (1) Year Shall Be Fixed And Shall Not Be Adjusted During The Contract Implementation, Except For The Following: 1. Increase In The Daily Minimum Wage Pursuant To Law Or New Wage Order Issue After Date Of Bidding; 2. Increase In Taxes; 3. If During The Term Of The Contract, Darpo Aklan Sees The Need For A Decrease In The Number Of Security Guards; G. Manner Of Payment 1. That The Contract Price Per Security Guard Is To Be Paid By Darpo Aklan On A Monthly Basis; 2. That Darpo Aklan Shall Be Responsible For The Withholding Of Taxes; 3. The Agency Should Absolutely Comply With The Labor Code And Applicable Minimum Wage Law Including Payment Of 13th Month Pay, Service Incentive Leave, Night Shift Differential, Uniform Allowance, Sss Premium, Philhealth Insurance And Pag-ibig Fund, Retirement Benefit, Overtime And Holiday Pay Etc. Without Additional Cost To The Darpo Aklan. The Agency Should Submit A Quarterly Report Of Their Compliance To Darpo Aklan. Non Compliance With The Said Requirements Or Non Submission Of Quarterly Report Of Compliance Shall Be A Ground For Revocation Of The Contract. 4. The Payment Will Be Paid/released To The Agency Through The Lddap.
