The following regulations on collective bargaining and social standards are part of the adequate transport service in order to ensure operational quality: Due to the labor market situation in the Rhine-Neckar metropolitan region and in the Bergstrasse district, the future operator is obliged to pay its employees at least the remuneration set out in the following collective agreements declared as representative in accordance with the Hvtg in order to ensure that the driving personnel have sufficient qualifications when performing the service, and to guarantee the working conditions set out in these collective agreements: - General collective agreement for commercial employees in private passenger transport by bus in Hesse, valid from April 1, 2019 (m-tv) - Wage collective agreement for employees in private. Passenger transport by bus in Hesse valid from April 1st, 2019 (e-tv) The special regulations for metropolitan area transport in § 7 A II. M-tv, § 3 E-tv and the general appendix to § 3 E-tv apply. This obligation applies dynamically for the entire term of the new contract period, i.e. always with reference to the adjustments to the collective agreements that will be made in the future. If subcontractors are used, they must also guarantee compliance with these obligations. In addition to the social standards to be guaranteed by the collective agreement, the following conditions apply to driving time interruptions and breaks for all drivers deployed: Driving time interruptions and breaks that are not considered working time under the collective agreement may not exceed 60 minutes per shift. If the driving time interruptions and breaks exceed this limit, the times of the work interruptions exceeding the 60-minute limit are to be counted as working time. A one-off work interruption per shift of at least 2 hours that begins and ends at the employee's place of residence (district) or at a company location with adequate social spaces counts as genuine, non-compensated free time in the sense of a split shift. The provision of social spaces is not relevant in this context if the work interruption lasts longer than 4 hours. The following regulations on the takeover of personnel are also part of the adequate transport service in order to ensure the quality of operation: As part of their offer, the bidders undertake to offer an employment contract to those drivers who are employed by the old operator of the route bundle for at least 70% of the regular working hours during the award process and who can show a valid employment contract with the old operator at the time of commissioning. The new employment contract is to be concluded for an indefinite period and without a probationary period. The offer of employment must be based on the collective agreement and company agreement conditions applicable to the rest of the workforce in the concessionaire's company. If the collective agreement in force in the acquiring company makes the amount of pay and the number of vacation days dependent on the length of service, the new employment contract must stipulate that the length of service with the old operator is to be counted as length of service in the acquiring company for the purposes of pay classification and vacation granting.
