Objective To Procure Brand New Motor Vehicles Intended For Use By The Board Of Investments (boi) For The Exercise Of Executive Functions Of A Head Of A Bureau Or Organization Equivalent To A Bureau, And Other Officials Of Equivalent Rank. Ii. Approved Budget For The Contract (abc) The 2024 Approved Budget For The Contract Is Eight Million Four Hundred Thousand Pesos (php 8,400,000.00). Iv. Delivery Schedule/location 52 The Brand New Vehicles Shall Be Delivered Within 120 Calendar Days From Receipt Of The Notice To Proceed (ntp) By The Winning Bidder At 385 Sen. Gil Puyat Avenue, Makati City. V. Liquidated Damages If The Supplier Fails To Satisfactorily Deliver Any Or All Of The Goods And/or Perform Their Services Within The Period Specified In The Contract Inclusive Of Duly Granted Time Extensions If Any, The Boi Shall Impose Liquidated Damages Shall Be At Least Equal To One-tenth Of One Percent (0.001) Of The Cost Of The Unperformed Portion For Every Day Of Delay. Once The Cumulative Amount Of Liquidated Damages Reaches Ten Percent (10%) Of The Amount Of The Contract, The Procuring Entity May Rescind Or Terminate The Contract, Without Prejudice To Other Courses Of Action And Remedies Available Under The Circumstances. Vi. Termination Of Contract The Boi May, At Any Given Time, Terminate The Contract For Breach Of Any Of The Provisions Thereof And Other Legal Causes By Serving A Written Notice To The Other Party At Least Thirty (30) Days Before The Intended Date Of Termination. Vii. Confidentiality Clause All Information, Data, And Documents Concerning The Business And Affairs Of The Boi That Are Classified As Confidential Shall Be Treated With Extreme Secrecy By The Supplier And Shall Not Be Communicated Or Disclosed To Any Person Or Entity Without Prior Written Clearance From Boi. Viii. Terms Of Payment Boi Shall Pay The Winning Bidder The Full Amount (as Indicated In The Financial Bid) Through Land Bank’s Lddap-ada/bank Transfer Facility Upon Complete Delivery Of All The Aforementioned Brand-new Vehicles And Upon Official Acceptance By The End-user Ix. Warranty For The Procurement Of Goods, In Order To Assure That Manufacturing Defects Shall Be Corrected By The Supplier, A Warranty Security Shall Be Required From The Winning Bidder For A Minimum Period Of Three (3) Months, In The Case Of Expendable Supplies, A Minimum Period Of Three (3) Years On The Body And Engine, After Acceptance By The Procuring Entity Of The Delivered Supplies. The Obligation For The Warranty Shall Be Covered By Either Retention Money In An Amount Equivalent To At Least One Percent (1%) Of Every Progress Payment, Or A Special Bank Guarantee Equivalent To At Least One Percent (1%) Of The Total Contract Price. The Said Amounts Shall Only Be Released After The Lapse Of The Warranty Period Or, In The Case Of Expendable Supplies, After Consumption Thereof: Provided, However, That The Supplies Delivered Are Free From Patent And Latent Defects And All The Conditions Imposed Under The Contract Have Been Fully Met. X. Vendor’s Qualification Bidder/s Must Have A Platinum Membership In The Philgeps;
