Whereas, The Requisitioner Requests That The Goods Be Covered Under Section 52.1(a) Of The Revised Irr Of R.a 9184, Whereas, The Above Requisitioner Is Included In The Annual Procurement Program(app) Of This Municipality, Whereas, Although Section 10 Of The Rirr Of Ra-9184 Prescribes That “all Procurement Shall Be Done Through Competitive Bidding”,the Same Provision Provides Exemptions, Whereas, Those Provisions Clearly Encourages Heads Of Agencies To Exercise Executive Discretions And Authority To Cope With Contingencies, Emergencies, And Exigencies Of The Service For The Expeditions, Effective, Economical And Efficient Delivery Of The Basic Services For The General Welfare Of The Constituency And Ensure That The Most Advantageous Price For The Government Is Obtained. Further, Public Bidding Is Too Cumbersome Process. Whereas, The Above Commodities/materials Are Within The Nature Of Operation And Necessary In The Transaction Of Official Business And Commonly Consume By The Requesting Official. Whereas, The Subject Amount Involved Does Not Exceed The P40,400.00 Threshold As Indicated In Annex”h” Of Irri And The Procurement Does Not Result In Splitting Of Contracts. Whereas, The Requisites For Shopping Were All Complied With: Wherefore, The Bac Recommends Purchase Of The Goods Through Shopping Under Section 52.1(a) Of The Irri. This 25th Day Of September, 2023.
