Contract notice: conclusion of a non-exclusive discount agreement according to § 130a para. 8 sgb v on medicinal products with the active ingredient botulinum toxin type a (atc code: m03ax21) Conclusion of a non-exclusive discount agreement according to § 130a para. 8 sgb v for medicinal products with the active ingredient botulinum toxin type a (atc code: m03ax21) within the period from 05/01/2022 to 04/30/2024 with the possibility of concluding a contract at any time during the term ("open-house model"). the contractual partners can be viewed at: https://www.Aok-gesundheitspartner.De/nds/arzneimittel/rabatt/index_03504.Html?bl=ndsthe aok lower saxony. until the entry into force of exclusive contracts according to the regulations of part 4 of the gwb, the health insurance company intends to conclude non-exclusive drug discount contracts for the active substance botulinum toxin type a (atc code: m03ax21) with as many market participants as possible (pharmaceutical entrepreneurs or groups of pharmaceutical entrepreneurs ) in the so-called "open-house model". the aok of lower saxony will not make a selection decision and will submit an identical contract offer to every interested pharmaceutical company. in the open-house model, uniform conditions apply to all participants. contract content, conditions and access procedures are uniform - individual negotiations are not conducted as a matter of principle. the contract terms are a maximum of twenty-four months, the earliest start of the contract is 05/01/2022. all contracts end on april 30th, 2024 at the latest, regardless of the date of the respective contract conclusion. a membership or a contract can be concluded within the twenty-four-month period on the first of each month. there is a right of termination six weeks to the end of the month. aok lower saxony reserves the right to replace the non-exclusive open-house discount contracts with exclusive discount contracts during the contract period. with the entry into force of advertised, exclusive discount contracts, the open-house contracts are terminated in accordance with the contractual provisions, i. h. the open-house contracts end automatically. according to the experience of aok lower saxony, exclusive discount agreements generally come into force six to eight months after the publication of the corresponding tender notice in the supplement to the official gazette of the european union. the future contractual partners in the open-house model are asked to regularly inform themselves about these tender announcements in the supplement to the official gazette of the european union. interested pharmaceutical companies can request the contractual documents and the contractual conditions at the contact address given under i.1). active ingredient botulinum toxin type a will be concluded for the first time with effect from 05/01/2022. interested parties who would like to become a contractual partner on this date must submit the contractual documents to
