(7) The contract may be terminated with one month’s notice from either side. (8) The agency shall maintain one attendance register at site, to be signed regularly by the staff on duty and the same should be authenticated/verified by the concerned Junior Engineer(Electrical) and Assistant Engineer(Electrical). The copy of this Attendance Register duly counter signed by the concerned Assistant Engineer(Electrical) should be submitted along with the bill quarterly. (9) The agency should must submit P.F and E.S.I’s challan and payment acknowledgement document of the respective Lift Operators/Attendant during submission of bill. (10) Bills should be submitted at the end of every three month with the certification of concerned Engineers on satisfactory completion. (11) The agency must have their office & Telephone contact with Mobile no. and the same should be intimated to this Department in writing. The telephone call should be responded without delay. (12) The agency shall provide photo identity cards to all the maintenance staff employed, including substitutes. (13) The agency will have to immediately replace any or all members of the Lift operational staff, who has been reported against. (14) Any shut down or fault should be brought to the notice of EIC immediately in writing and over telephone for further course of action.

(15) The Department would not be held responsible for any accident of the Liftman on duty for any reason. The Contractor or their Lift Operator would not claim any compensation in any shape from this department for such accident. (16) The agency should submit a copy of the Duty Roster of the Lift Operator at the beginning of each month (or as directed time to time) to the concerned Junior Engineer(Electrical) and the concerned duty officers of Prashasan Bhaban, Sur.

(17) Valid Authorisation Letter duly issued by the Licensing Board, Identity proof etc. are to be furnished for each Lift Operator / Attendant engaged by the concerned agency along with the name & contact no. of the persons and all these information with supporting documents are to be submitted in written to the concerned Junior Engineer(Electrical), Assistant Engineer(Electrical) & Executive Engineer(Electrical). (18) If any kind of incapability & negligence are noticed in observing all the above-said terms & conditions, this Department posses the right to deduct the cost from the bills of the contractor on pro-rate basis as determined by the Engineer-In-Charge. In that case, the above-said contract may be terminated without issuing any notice and Stringent & punishable action may be taken against the contractor. (19) No. quotation with price variation clause will be accepted. Rates offered should be stable for the entire period of maintenance. (20) The agency has to obey the labour department rules strictly.

The philosophy of “Public Interest” would be the MOTTO of this maintenance contract. Any deviation may be viewed otherwise. If any kind of incapability & negligence are noticed in observing all the above-said terms & conditions causing inconveniences to public service, is subject to unilateral penalty, be it detected on the spot or thereafter (even after payment). This Department also reserves the right to deduct the cost from the bills of the contractor on pro-rata basis as determined by the Engineer –In-Charge for any shortfall in observing above T&C. In that case, the above-said contract may be terminated without issuing any notice and Stringent & punishable action may be taken against the contractor.
