Memo''o.1.0AS-58 Dated: KlTl/( Subject: Use of Bitumen in Development Works. At present the contractual agencies are procunng the Bitumen from the Government refineries for executing the road works and the payment of bituminous items are being released on the basis of submission of refinery bills. The PWD (B&R) has allowed to use imported bitumen also in the year 2010 in addition to the Government rehnery bitumen subject to the condition that thc quality of bitumen should meet the laid down specifications in the DNIT. The payment of escalation/de-escalation will be made on the prevailing rates of IOC refinery at Panipat. The HSAMB has also decided to adopt the same procedure to maintain parity with PWD (B&R) so the use of imported bitumen has also been allowed in ongoing & future works. The contractor can arrange the bitumen from any of the refinery or import tlr.' same subject to the condition that the quaiity of bitumen is as per the requirement of contract & specifications. Regarding payment of price variation of bitumen as per the agreement, Lhe escalation/de-escalation wiil be paid on the basis of lesser cost rmplication to t]'re Department on consideralion of the diffcrence in rates as given below subject to financial regularity and other terms & conditions of the agreement:- (i) Prevailing rates of IOC refinery at Panipat on the date of tender and at the time of purchase of bitumen. (ii) Prevailing rates on the date of purchase of imported bitumen by the contractual agency. It is further clarified that:- a. When recovery is due on account of decrease in rates of bitumen, higher of the difference in rates of IOC, Panipat and that of private refinery/sector shali be considered. b. When escalation is due to increase in rates of bitumen is due to the agenc-v, thcn lesser of the difference in rates of IOC, Panipat and thaL of private refinery/sector from where bitumen was purchased shall be considered. The conditions as per 'Annexure-A' be incorporated in the DNITs for future development works. An undertaking as per 'Annexure-B' be obtained from the agency before allowing him to procure Lhe privatc bitumen for ongoing development works. These orders shall take immediate effect. The bill/voucher should pertain to the period of original contractual time limit and should correspond with the progress of the work. No extra payment due to increase in rate of bitumen/emulsion will be paid if the originai bill/voucher are not submitted by the agency. No increase in price of the bitumen/emulsion shall be reimbursed to the contractor beyond the original time period allowed for construction as per contact agreement irrespective of extension of time limit granted to the agency for any reason, whatsoever.
