Project Title: Exhaust Air/emission Testing Of Two (2) Units 2,500 Kva And Two (2) Units 750 Kva Generator Sets. Ii. Approved Budget For Contract (abc): One Hundred Fifty Thousand Pesos (₱ 150,000.00), Vat Inclusive Iii. Scope Of Works And Specifications: Supply Of Labor, Technical Expertise And Supervision As Well As Provision Of Tools, Equipment And Needed Instrument/s For The Exhaust Air Emission Testing Of The Two (2) Units 2,500 Kva Or 2,000 Kw And Two (2) Units 750 Kva Or 600 Kw Electrical Power Generator Sets To Include But Not Necessarily Limited To The Following: 1. Mobilization Of Equipment. 2. Take Samples Of Exhaust Air/emission From The Exhaust Pipe Of The Subject Generator Sets On Three (3) Sampling Runs Conducted Per Unit. 3. Conduct Laboratory Analysis On The Taken Sample For Carbon Monoxide (co) And Nitrogen Oxides (nox). 4. Prepare And Submit Report On The Result Of The Conducted Laboratory Analysis On The Required Exhaust Air Parameters. Iv. Terms Of Payment: Payment Shall Be Released In Full Within 3 To 4 Weeks After Final Acceptance By Picc Or Its Representative Of The Contractor’s Completed Work, And Submission Of Billing And Complete Supporting Documents By Contractor As Follows: 1.) Turn-over Report/certification For Completion 2.) Invoice. 3.) Bank Guaranty Equivalent To Five Percent (5%) Of The Contract Amount. Note: Bank Guaranty Is Not Necessary If The Contractor Chooses The Warranty Obligation In The Form Of Five Percent (5%) Retention Money. However, In Case That A Generator Set Will Fail To Operate Properly During The Sampling Test Schedule. Picc Reserves The Right To Cancel And Deduct Its Corresponding Cost From The Total Contract Cost. V. Schedule Of Requirements: Completion Shall Be Within Fourteen (14) Calendar Days After Receipt Of Request For Services (r. S.)/notice To Proceed For The Required/agreed Test Periods. The Contractor Shall Be Granted Extension Of Completion Time For Additional Work/s Not Covered Herein Due To Any Work Delays Attributable To Picc. In Case Of Delay In The Required Completion Time Or Delivery Period, Inclusive Of Duly Granted Time Extensions If Any, The Contractor Shall Be Liable For Damages For The Delay And Shall Pay The Picc For Liquidated Damages An Amount Equivalent To 1/10th Of One Percent (1%) Of The Total Value Of The Unfinished Part Of The Project For Each Day Of Delay Until Such Time The Project Is Finally Completed And Accepted By Picc. Said Penalty On Delay Shall Be Charged To Any Amount Due To The Contractor, Or In The Absence Or Insufficiency Thereof, From The Performance Bond/security. In Case Of Insufficiency Of The Bond, The Contractor Shall Pay The Balance To Picc Upon Notice. Vi. Warranty: Three (3) Months Warranty For Workmanship By The Contractor. The Obligation For The Warranty Shall Be Covered By, At The Contractor’s Option, Either Retention Money In An Amount Equivalent To Five Percent (5%) Of The Contract Amount, Or A Bank Guarantee Equivalent To Five (5%) Percent Of The Total Contract Amount. Said Warranty Obligation Shall Be Released Only After The Expiration Of Warranty Period, However, The Same Will Be Forfeited By Picc As Part Of Payment For Any Damage Of The Units Involved If The Contractor Refuses Or Fails To Restore/repair The Damaged Components/parts Attributable To Contractor’s Negligence Or Poor Workmanship During The Sampling/testing Period. Vii. Other Conditions: 1. The Contractor Must Be A Denr-accredited Or Recognized Air Emission Testing Company. 2. The Contractor Must Conduct Site Survey And Inspection. 3. Any Work That May Affect The Operation And Security Measures Of Picc Shall Be Coordinated Properly And Shall Be Done In Accordance With The Picc’s Approved Schedule. 4. Test/s Should Be Done In Accordance With The Prescribed Sampling Methodologies (usepa Method 10 For Co, Method 7 For Nox As Stipulated In The Irr Of Ra 8749). Each Emission Test Should Consist Of Three (3) Sampling Runs Per Unit. 5. Report On The Air Monitoring Result Shall Be In Two (2) Sets. One (1) Set Shall Be For The Nox Result And The Other One Would Be For The Co Tests Result. 6. The Contractor Should Free The Picc And Its Personnel From And Against All Liabilities Arising From Injuries Or Liabilities To Persons Or Damages To Property Occasioned By Any Act Or Omissions By The Contractor Including Any And All Expenses, Legal Or Otherwise Which May Be Incurred By Picc And Its Personnel In The Defense Of Any Claim, Action Or Suit. 7. The Contractor Shall Provide Its Needed Scaffolds To Be Assembled By Its Properly Trained Personnel. 8. The Contractor Shall Provide A Sufficient Number Of Safety Personnel For The Duration Of The Work. Safety Personnel Shall Monitor The Contractor’s Personnel As They Carry Out The Work And Be Responsible For Hazard Assessment, First Aid, Safety Watch, Spotter Duties, Gas Monitoring, Hot Works Monitoring, Scaffolding Works Monitoring, Etc. 9. The Contractor Shall Ensure That Its Assigned Personnel And/or Representatives Shall Comply With, And Submit Themselves To, The Rules And Policies Of The Picc On Security, Sanitation, Environmental Compliance, Safety And Health Protocols And Other Regulations. 10. The Contractor Must Submit Nbi Or Barangay Of Each Personnel To Be Assigned At The Picc. 11. The Contractor’s Personnel Should Wear Its Company Uniform/id At All Times While Inside The Picc Premises. Viii. Quotations: All Quotations Shall Conform With The Following Conditions: A. Quotation/offer For The Sampling And Testing/laboratory Analysis Including All Any Other Work/ Charges Shall Be In Philippine Peso. B. Bid Prices Must Be Firm For At Least One Hundred Twenty (120) Calendar Days After The Date Of Bidding. Bidders’ Proposal Must Conform With All The Stipulated Specifications So With The Sequence Of The Article(s) Listed In The Proposal Form. Ix. Withholding Tax: The Picc Shall Withhold And Deduct The Corresponding Tax From The Amount Shown In The Awardee’s Invoice Subject To The Provision Of Applicable Laws And/or Obligation. X. Contractor’s Technical Qualification: The Contractor (the Company Or Its Officers) Must Be Engaged In Business For The Exhaust Air/emission Sampling/testing And Laboratory Analysis For Electrical Power Generators, Stationary Engines And Allied Air Pollution Source Equipment And Related Requirements For At Least Three (3) Years. Xi. General Conditions Of The Contract: 1. All Prices Quoted Herein Are Valid, Binding And Effective For One Hundred Twenty (120) Calendar Days From Date Of Quotation. 2. The Contractor Shall Be Responsible For The Source(s) Of His Services/equipment Shall Make Deliveries In Accordance With Schedule, Quality And Specifications. Failure By The Awardee To Comply With The Same Shall Be Ground For Cancellation Of The Award. 3. The Contractor Shall Pick Up Rs And Ntp Issued In His Favor Within Three (3) Days After Receipt Of Notice To That Effect. A Telephone Call, Fax Transmission Or Email Shall Constitute An Official Notice To The Awardee. Thereafter, If The Rs Remain Unclaimed, The Said Rs Shall Be Sent By Messengerial Service To The Awardee At The Latter’s Expense. To Avoid Delay In The Service Of The Requesting Agency’s Requirement, All Defaulting Awardees Shall Be Precluded From Proposing Or Submitting A Substitute Sample. 4. Subject To The Provisions Of The Preceding Paragraph, Where Awardee Has Accepted A Ntp But Fails To Deliver The Services Within The Time Called For In The Same Order, He Shall Be Extended A Maximum Of Fifteen (15) Calendar Days Under Liquidated Damages To Make Good His Services. Thereafter If Awardee Has Not Completed Delivery Of Services Within The Extended Period, The Subject Rs & Ntp Shall Be Cancelled And The Award For The Undelivered Balance Withdrawn From That Awardee. The Picc-bac Shall Then Purchase The Required Services From Such Other Source(s) As It May Determine, With The Difference In Price To Be Charged Against The Defaulting Awardee. Refusal By The Defaulting Awardee To Shoulder The Price Difference Shall Be Ground For His Disqualification From Future Bids Of The Same Or All Items, Without Prejudice To The Imposition Of Other Sanctions As Prescribed Under Ra 9184 And Its Irr-a. 5. All Services By The Contractor Shall Be Subject To Inspection And Acceptance By The Picc. 6. A Penalty Of One Tenth (1/10) Of One Percent (1%) Of The Total Value Of The Uncompleted Services/works Shall Be Deducted For Each Day Of Delay Including Sundays And Holidays In The Delivery Of The Services. 7. All Transactions Are Subject To Withholding Of Creditable Value Added Tax (vat) Per Revenue Regulation No. 10-93.
