Description Terms Of Reference Procurement Of Cup Trophies For The 2024 Philracom Triple Crown Series I. Objective The Philippine Racing Commission (philracom) Intends To Engage The Services Of A Supplier That Can Produce And Deliver Three (3) Units Of Trophies To Be Conferred To The Winners Of The 2024 Philracom Triple Crown Series. Ii. Rationale In Keeping With Its Mandate To Promote And Direct The Accelerated Development Of The Horseracing Industry, It Is A Critical Initiative Of The Commission To Highlight And Increase Awareness And Prestige Of The Stakes Races – These Being Major Thoroughbred Horseracing Events In The Country – Which Feature Elite Horses. In This Regard, The Commission Deems It Necessary To Engage The Services Of A Supplier, Which Will Produce And Provide Trophies That Will Evoke The Spirit And Excitement Of These Major Racing Events, Reflect The Excellence Of The Stakes Races, And Withstand The Test Of Time, Serving As Enduring Symbols Of Achievement. The Supplier Must Thus Ensure That The Trophies Meet High-quality Standards In Terms Of Design, Craftsmanship, And Durability. Iii. Project Description This Procurement Project Entails The Manufacture Of Three (3) Gold-plated Cup Trophies Based On The Approved Design For The 2024 Philracom Triple Crown Series, Scheduled On: A. 1st Leg - 19 May 2024 B. 2nd Leg - 23 June 2024 C. 3rd Leg - 21 July 2024 Iv. Approved Budget For Contract (abc) The Fund For This Procurement Shall Be Sourced From The General Appropriations Act (gaa) For The Fiscal Year 2024 Of The Philippine Racing Commission. The Approved Budget Of The Contract Is Six Hundred Thousand Pesos (php 600,000.00), Inclusive Of All Government Taxes And Duties. V. Mode Of Procurement The Procurement Shall Be Undertaken Through Negotiated Procurement (small Value Procurement) Under The 2016 Revised Implementing Rules And Regulations (irr) Of Republic Act (ra) 9184, Otherwise Known As The “government Procurement Reform Act”. Vi. Qualification Of The Supplier A. The Supplier Must Be A Reputable Trophy Designer/manufacturer, With An Updated Business License And With Experience In The Field Of Designing / Manufacturing Trophies; B. The Supplier Must Be Philgeps Registered; C. The Supplier Must Submit A Company Profile. Vii. Deliverables Three (3) Gold-plated Cup Trophies With Engraving And Wooden Base Made From Solid Materials With A Plate For The Title Of The Stakes Race. The Dimension Of The Trophy Will Have At Least Seven (7) Inch-cup And Five (5) Inch-wooden Base, Totaling Twelve (12) Inches In Height To Be Used For The Triple Crown Series (1st Leg, 2nd Leg, And 3rd Leg). Viii. Schedule Of Requirements A. The Supplier Shall Deliver The Required Trophies To The Address Below: Philippine Racing Commission, 4f Electra House Bldg., Esteban St., Legaspi Village, Makati City B. The Supplier Must Comply With The Following Delivery Schedule: 1. One (1) Trophy For The 1st Leg Tc - 03 May 2024 2. One (1) Trophy For The 2nd Leg Tc - 07 June 2024 3. One (1) Trophy For The 3rd Leg Tc - 05 July 2024 Ix. Responsibilities Of The Supplier A. The Supplier Must Deliver The Required Trophies In Accordance With The Specifications Submitted And Design Approved By The Philracom. B. The Supplier Must Deliver The Required Trophies Following The Delivery Schedule Specified In This Document. X. Payment A. Payment Shall Be Made Upon Delivery Of Each Item In Accordance With The Delivery Schedule Duly Certified And Accepted By The End User. B. Payment Shall Be Made Within Fifteen (15) Days After Submission Of The Billing And Certificate Of Completion And Acceptance. Xi. Liquidated Damages A. When The Supplier Fails To Satisfactorily Deliver Goods Under The Contract Within The Specified Delivery Schedule, Inclusive Of Duly Granted Time Extensions, If Any, The Supplier Shall Be Liable For Damages For The Delay And Shall Pay The Procuring Entity Liquidated Damages, Not By Way Of Penalty, An Amount Equal To One-tenth (1/10) Of One Percent (1%) Of The Cost Of The Delayed Goods Scheduled For Delivery For Every Day Of Delay Until Such Goods Are Finally Delivered And Accepted By Philracom. B. Philracom Need Not Prove That It Has Incurred Actual Damages To Be Entitled To Liquidated Damages. Such Amount Shall Be Deducted From Any Money Due Or Which May Become Due To The Supplier, Or Collected From Any Securities Or Warranties Posted By The Supplier, Whichever Is Convenient To The Procuring Entity Concerned. C. In Case The Total Sum Of Liquidated Damages Reaches Ten Percent (10%) Of The Total Contract Price, Philracom May Rescind The Contract And Impose Appropriate Sanctions Over And Above The Liquidated Damages To Be Paid. Xii. Right To Accept Or Reject Quotation And/or Annul The Procurement Process Philracom Reserves The Right To Accept Or Reject Any Quotation, To Annul The Procurement Process, Or Not To Award The Contract Without Thereby Incurring Any Liability To The Affected Bidder Or Bidders. Xiii. Conformance With The Existing Laws The Procurement Process For This Undertaking Shall Be Executed In Accordance With Republic Act 9184, Otherwise Known As The Government Procurement Reform Act, And Its Revised Implementing Rules And Regulations.
