Description Terms Of Reference Procurement Of Contractor For The Repair And Replacement Of Damaged Kitchen Sink, Kitchen Sink Cabinets, Countertop, And Sanitary Drain Pipe I. Project Description To Acquire A Reputable And Competent Contractor That Will Provide The Supply And Delivery Of Materials And Labor For The Repair And Replacement Of Damaged Kitchen Sink, Kitchen Cabinets, Countertop, And Sanitary Drain Pipe. Ii. Background And Objective The Philippine Racing Commission (philracom) Is A Government Office Located At The 4th Floor Of The Electra House Building, Legaspi Village, Makati. As Part Of Its Commitment To Maintaining A Safe And Functional Environment For All Staff Members And Visitors, Philracom Continuously Implements Measures To Properly Maintain Its Facilities. After A Routine Inspection, The Office Has Identified A Need To Repair The Following Damaged Kitchen Facilities: 1. Kitchen Sink 2. Kitchen Cabinets 3. Countertop 4. Sanitary Drain Pipe The Said Facilities Have Deteriorated Significantly, Resulting In Frequent Water Leaks. This Persistent Issue Has Become A Major Nuisance, Causing Inconvenience And Potential Damage To The Surrounding Areas. Additionally, The Sanitary Drain Pipe Is Directly Connected To The Building’s Main Sanitary Pipe, Which Has Caused Damage To The Floor Below The Office. This Situation Has Particularly Affected Areas Beyond Our Own Property, Creating Additional Complications. The Project Aims To Ensure The Long-term Integrity And Functionality Of The Facilities, Preventing Future Incidents And Safeguarding The Property Against Potential Water-related Disasters. Iii. Scope Of Work The Contractor Shall Undertake The Following Works, While Completely Supplying And Delivering The Labor, Materials, And Equipment: 1. Kitchen Sink A. Removal Of The Damaged Kitchen Sink; B. Removal Of The Damaged Leaking Faucet; C. Installation Of New Sink With Specifications: 3 Mm. Thick Double Bowl Stainless Steel With 82 Cm. X 45 Cm. X 20 Cm. Dimensions; D. Installation Of A New Goose-neck Faucet. 2. Kitchen Cabinets A. Removal Of The Deteriorating Cabinets; B. Installation Of New Cabinet Using 3/4-thick Marine Plywood Including Hinges And Handles. 3. Countertop A. Removal Of The Damaged Countertop; B. Installation Of New Countertop Using 60 Cm. X 60 Cm. Tiles. 4. Sanitary Drain Pipe A. Removal Of The Damaged Sanitary Drain Pipe Connecting The Kitchen And The Private Bathroom; B. Installation Of New Pipeline And Wye Fitting Using Pvc Pipe. 5. Others A. Hauling Of Debris And Other Scrap Materials During And After The Repair Works; B. Cleaning Of The Workstations And Disposal Of Garbage And Debris; C. Project Supervision And Management To Ensure Strict Compliance With The Project Requirement, Including Application Of Necessary Permits. Iv. Contract Duration The Project Must Be Completed Within Fifteen (15) Days From The Receipt Of The Notice To Proceed. The Contractor Shall Perform The Work After Office Hours And During Weekends. V. Institutional Set-up/responsibilities A. Responsibilities Of Philracom: 1. To Provide A Space Within The Office For The Contractor's Equipment, Facilities, And Working Crew While They Are Performing Their Work Assignment; 2. To Monitor The Working Crew Of The Contractor While Performing Their Duties; 3. To Allow The Use Of Electricity And Water In The Performance Of The Job; 4. To Conduct Periodic Inspection On The Extent Of Accomplishment While Work Is Being Done; 5. To Thoroughly Inspect The Project Upon Completion And Issue A Certificate Of Completion And Acceptance, Through A Representative, In Accordance With The Scope Of Work Stated Herein; 6. To Prepare All The Necessary Documentation For Its Payment. B. Responsibilities Of Contractor 1. To Complete The Project Within The Specified Duration/period; 2. To Be Solely Responsible For The Wages, Benefits, Allowances, Health And Safety Of Its Personnel And Employees; 3. To Provide The Equipment, Tools, And Mechanisms In The Completion Of The Project; 4. To Equip Its Personnel And Works With Proper Working Uniform, Personal Identification, And Personal Protective Equipment (ppe) At All Times; 5. To Exercise All Standard Safety Measures And Precautions In The Course Of The Project; And 6. To Provide The Warranty Certificate Of Product And Services/ Workmanship For At Least Six (6) Months After The Issuance Of The Certificate Of Completion And Acceptance. 7. To Secure All Permits Needed For The Projects. Vi. Qualifications Of The Contractor A. The Contractor Must Be Registered With The Philippine Government Electronic Procurement System (philgeps). B. The Contractor Must Be Pcab Accredited Sp-ps, At Least Category D. C. The Contractor Must Be Engaged In Business For At Least Three (3) Years; And D. The Contractor Must Have An Updated Mayor’s Permit/business Permit, Sec/dti Registration, And Bir Form 2303 Vii. Payment Schedule Payment Shall Be Made Upon Completion Of The Above Scope Of Work Duly Certified And Accepted By The End User. Payment Shall Be Made Within Fifteen (15) Days After Submission Of The Billing And Certificate Of Completion And Acceptance. Viii. Mode Of Procurement The Procurement Shall Be Undertaken Through Negotiated Procurement (small Value Procurement) Under The 2016 Revised Implementing Rules And Regulations (irr) Of Republic Act (ra) 9184, Otherwise Known As The “government Procurement Reform Act”. Ix. Fund Source And Approved Budget For The Contract (abc) Fund For This Project Shall Be Sourced From The General Fund. The Abc Of The Proposed Undertaking Is One Hundred Thousand Pesos Only (php 100,000.00), Inclusive Of All The Applicable Government Taxes And Charges And Professional Fees. X. Penal Clauses A. Liquidated Damages If The Contractor Fails To Deliver Any Or All Of The Goods And/or To Perform The Services Within The Period Specified In This Contract, The Procuring Entity (philracom) Shall, Without Prejudice To Its Other Remedies Under This Contract And Under The Applicable Law, Deduct From The Contract Price As Liquidated Damages, The Applicable Rate Of One-tenth (1/10) Of One Percent (1%) Of The Cost Of Unperformed Portion Of Every Day Of Delay. The Maximum Deduction Shall Be Ten Percent (10%) Of The Amount Of The Contract. Once The Maximum Is Reached, The Procuring Entity Reserves The Right To Rescind The Contract, Without Prejudice To Other Courses Of Action And Remedies Available To It Under The Law. The Damages Herein Provided Are Fixed And The Philracom Shall Not Be Required To Adduce Proof Thereof. B. Other Costs Should The Philracom Be Constrained To File A Suit To Obtain Relief Against The Contractor, The Latter Shall Be Liable To Pay An Amount Equivalent To Twenty Percent (20%) Of The Amount Claimed In The Complaint As Attorney’s Fees, Aside From The Costs Of Litigation And Other Expenses, Which The Philracom Is Entitled To Recover From The Contractor; Provided, However, That Any Action Brought By The Contractor For Whatever Cause Arising From The Contract, Should It Be Adjudged Not To Be Entitled To The Relief Sought, The Philracom As The Prevailing Party Shall Be Entitled To Such Reasonable Attorney’s Fees, Costs Of Litigation And Other Costs It May Have Incurred By Reason Of Such Action. C. Indemnity The Contractor Shall Defend, Indemnify, And Hold Harmless The Philracom Against All Claims, Losses, Liabilities, And Damages, And Pay All Claims, Judgments, Awards, Costs, And Expenses Arising Out Of Or In Connection With The Contractor’s Acts Of Omissions, Unless Such Claims Are Due Solely To The Negligence Of The Philracom. Costs Inclusive Of Expert Witness Fees And Other Legal Expenses Shall Be Charged Against The Account Of The Contractor. D. Forfeiture The Failure Of The Contractor To Comply With Any Of The Requirements Or Undertakings Hereof Shall Constitute Sufficient Ground For The Forfeiture Of Its Performance Security. E. Other Costs The Contractor Shall Not Be Liable For Failure Or Delay In Performing Obligations Set Forth In This Contract If Such Failure Or Delay Is Due To Any Cause Reasonably Beyond The Control Of The Contractor. Xi. Performance Security To Guarantee The Faithful Performance By The Contractor Of Its Obligations Under The Contract, It Shall Post A Performance Security As Required Under Section 39 Of The Revised Irr Of Ra 9184 Prior To The Signing Of The Contract. The Performance Security Shall Be Denominated In Philippine Pesos And Posted In Favor Of Philracom, Which Shall Be Forfeited In The Event It Is Established That The Contractor Is In Default In Any Of Its Obligations Under The Contract. Xii. Right To Accept Or Reject Quotation And/or Annul The Procurement Process Philracom Reserves The Right To Accept Or Reject Any Quotation, To Annul The Procurement Process, Or Not To Award The Contract Without Thereby Incurring Any Liability To The Affected Bidder Or Bidders. Xiii. Conformance With The Existing Laws The Procurement Process For This Undertaking Shall Be Executed In Accordance With Republic Act 9184, Otherwise Known As The Government Procurement Reform Act, And Its Revised Implementing Rules And Regulations.
