Description Terms Of Reference Procurement For The Supply And Delivery Of Various Inks And Toner Cartridge I. Project Description To Acquire A Reputable And Competent Supplier Of Inks And Toner Cartridges For Office Consumption. Ii. Objective To Ensure An Uninterrupted Supply Of Ink And Toners Which Is Essential To The Smooth Day-to-day Operation Of The Office, And To Avoid Any Disruptions That May Hinder Employees From Efficiently Carrying Out Their Tasks. Iii. Scope Of Work And Specifications A. Canon 810 Black 2 Cart 1,000.00 Total 62,300.00 B. The Date Of The Manufacture Of The Items Shall Be Clearly Written On The Items Or Their Packaging. Items Must Also Not Expire Within Two (2) Years From The Date Of Delivery. C. Only Genuine/original And Brand-new Inks And Toner Cartridges That Come In Sealed And Securely Packed Shall Not Be Accepted. Refurbished And Refillable Items Shall Not Be Accepted; D. The Supplier Shall Replace Ink And/or Toner Cartridge/s Found Defective Within Five (5) Working Days After The Problem Has Been Reported. In Addition, The Replacement Of Ink And/or Toner Cartridge/s And All Related Costs Shall Be For The Account Of The Supplier. Iv. Schedule Of Delivery A. The Supplier Shall Deliver The Inks And Toner Cartridges To The Address Below: Philippine Racing Commission 4f Electra House Bldg., Esteban St., Legaspi Village, Makati City B. The Supplier Shall Deliver The Inks And Toner Cartridges Within Ten (10) Days Upon Receipt Of The Notice To Proceed. V. Qualifications Of The Supplier A. The Supplier Must Be Registered With The Philippine Government Electronic Procurement System (philgeps). B. The Supplier Must Have An Updated Mayor’s Permit/business Permit, Sec/dti Registration, And Bir Form 2303. Vi. Payment Schedule Payment Shall Be Made Upon Complete Delivery Of The Required Inks And Toner Cartridges Duly Certified And Accepted By The Inspection And Supply Officers And Within Fifteen (15) Days After Submission Of A Billing Statement. Vii. Mode Of Procurement The Procurement Shall Be Undertaken Through Alternative Method Of Procurement - Shopping Under The Updated 2016 Revised Implementing Rules And Regulation Of Republic Act No. 9184, Otherwise Known As The “government Procurement Reform Act”. Viii. Fund Source And Approve Budget For The Contract (abc) Fund For This Procurement Shall Be Sourced From The General Fund. The Abc Is Sixty-two Thousand Three Hundred Pesos (php 62,300.00), Inclusive Of All Government Taxes, Fees And Charges. Xi. Liquidated Damages A. When The Supplier Fails To Satisfactorily Deliver Goods Under The Contract Within The Specified Delivery Schedule, Inclusive Of Duly Granted Time Extensions, If Any, The Supplier Shall Be Liable For Damages For The Delay And Shall Pay The Procuring Entity Liquidated Damages, Not By Way Of Penalty, An Amount Equal To One-tenth (1/10) Of One Percent (1%) Of The Cost Of The Delayed Goods Scheduled For Delivery For Every Day Of Delay Until Such Goods Are Finally Delivered And Accepted By Philracom. B. Philracom Need Not Prove That It Has Incurred Actual Damages To Be Entitled To Liquidated Damages. Such Amount Shall Be Deducted From Any Money Due Or Which May Become Due To The Supplier, Or Collected From Any Securities Or Warranties Posted By The Supplier, Whichever Is Convenient To The Procuring Entity Concerned. C. In Case The Total Sum Of Liquidated Damages Reaches Ten Percent (10%) Of The Total Contract Price, Philracom May Rescind The Contract And Impose Appropriate Sanctions Over And Above The Liquidated Damages To Be Paid. Xii. Right To Accept Or Reject Quotation And/or Annul The Procurement Process Philracom Reserves The Right To Accept Or Reject Any Quotation, To Annul The Procurement Process, Or Not To Award The Contract Without Thereby Incurring Any Liability To The Affected Bidder Or Bidders. Xiii. Conformance With The Existing Laws The Procurement Process For This Undertaking Shall Be Executed In Accordance With Republic Act 9184, Otherwise Known As The Government Procurement Reform Act, And Its Revised Implementing Rules And Regulations.
