Description 1. Bidders Shall Provide Correct And Accurate Information Required In This Form. 2. Price Quotation/s Must Be Valid For A Period Of Sixty (60) Calendar Days From The Date Of Submission Of Quotation. 3. Price Quotation/s, To Be Denominated In Philippine Peso, Shall Include All Taxes, Duties And/or Levies Payable. 4. Quotations Exceeding The Approved Budget For The Contract Shall Be Rejected. 5. Award Of A Contract Shall Be Made For Each Similar Item/s Or Lot/s To The Lowest Calculated And Responsive Quotation (for Goods And Infrastructure) Or The Highest Rated Offer (for Consulting Services), Which Complies With The Minimum Technical Specifications And Other Terms And Conditions Stated Herein. 6. Any Interlineations, Erasures Or Overwriting Shall Be Valid Only If They Are Signed Or Initialed By You Or Any Of Your Duly Authorized Representative/s. 7. The Item/s Shall Be Delivered According To The Requirements Specified In The Technical Specifications And Schedule Of Delivery. 8. The Nfa-ro1 (region 1) Shall Have The Right To Inspect And/or Test The Goods To Confirm Their Conformity To The Technical Specifications At No Extra Cost To The Nfa Ro1 And Automatically Reject Them Once Found Non-conforming. 9. In Case Two Or More Bidders Are Determined To Have Submitted The Lowest Calculated Quotation/lowest Calculated And Responsive Quotation, The Nfa-ropc (region 1) Shall Adopt And Employ “draw Lots” As The Tie-breaking Method To Finally Determine The Single Winning Provider In Accordance With Gppb Circular 06-2005. 10. Payments Shall Be Promptly, But In No Case Later Than Sixty (60) Days, After Submission Of Billing Statement/invoice, Required Supporting Documents, And Upon Fulfillment Of Other Obligations As Stipulated In The Contract As Well As Upon Inspection And Acceptance Of The Goods By The End User In Accordance With Existing Government Accounting Rules And Regulations. In Order To Protect The Interest Of The Nfa-region 1, The Nfa May Refuse Payment When There Is An Evident Failure By The Provider To Comply With The Terms And Conditions In The Delivery Of Services Agreed Hereto. 11. To Assure That The Supplier Will Correct Manufacturing Defects, Warranty Security Shall Be Required From The Contract Awardee For A Minimum Of Three (3) Months, In The Case Of Expendable Supplies, And A Minimum Period Of One (1) Year, In The Case Of Non-expendable Supplies, After The Procuring Entity Accepts The Delivered Supplies. Form Of Warranty Security Amount Or Percentage Required Retention Money 2% Of The Total Contract Price Or Special Bank Guarantee 2% Of The Total Contract Price The Said Amount Shall Only Be Released After The Lapse Of The Warranty Period As Provided In The Warranty Certificate By The Supplier/contractor. Provided, However, That The Pesticides Delivered Are Free From Patent And Latent Defects And That All The Conditions Imposed Under The Contract Have Been Fully Met. A Warranty Certificate Shall Be Provided By The Awardee Within 3 Working Days From The Date Of Acceptance By Nfa. 12. The Liability Of The Supplier Under This Contract Shall Be As Follows And As Provided By The Laws Of The Republic Of The Philippines: A. The Supplier Shall Replace The Defective And/or Rejected Pesticides Within Three (3) Calendar Days From The Date Of Receipt Of Notice Of Rejection With Those That Conform With Specifications, At No Cost To The Nfa. B. No Rejected Pesticide/s Deliveries Shall Be Withdrawn Until Corresponding Replacements Have Been Delivered And Accepted By Nfa. C. Failure To Deliver The Pesticides Within The Delivery Period As Stated In The Notice To Proceed/purchase Order Including The Replacement Period Of Rejected Deliveries, For Any Cause Not Attributable To Nfa, Shall Make The Supplier Liable To Penalties Equivalent To One Tenth Of One Percent (0.1%) Of The Money Value Of Undelivered Quantity For Every Day Of Delay, The Amount Of Which Shall Be Deducted From Any Amount Due To The Supplier From Nfa. 13. Liquidated Damages Equivalent To One-tenth Of One Percent (0.1%) Of The Value Of The Goods Not Delivered Within The Prescribed Delivery Period Shall Be Imposed Per Day Of Delay. The Nfa-iro (region 1) May Rescind The Contract Once The Cumulative Amount Of Liquidated Damages Reaches Ten Percent (10%) Of The Amount Of The Contract, Without Prejudice To Other Courses Of Action And Remedies Open To It. 14. Reservation Clause- The National Food Authority- Region 1 Reserves The Right To Reject Any And All Bids, Declare A Failure Of Bidding, Or Not Award The Contract At Any Time Prior To Contract Award In Accordance With Section 41 Of Ra 9184 And Its Irr, Without Thereby Incurring Any Liability To The Affected Bidder Or Bidders. Other Terms And Conditions Of The Contract: A. Obligations Of Nfa 1. The Nfa Shall Execute The Notice Of Award/ Notice To Proceed/ Purchase Order Within Seven (7) Calendar Days From The Date Of The Contract For The Supply And Delivery Of The Pesticide Requirements. 2. The Nfa Shall Designate The Regional Standards Quality Assurance Officer (rsqao) As Its Duly Authorized Representative To Inspect In Coordination With The Other Members Of The Regional Inspection Team And To Receive The Pesticide Deliveries Made By The Supplier/s At The Delivery Site Indicated In Technical Specification. 3. The Nfa Shall Only Accept The Item/s That Conform To The Technical Specifications. 4. The Rsqao Shall Sign The Delivery Receipt And Invoice Receipt For The Property Of All Accepted Pesticides. 5. The Rsqao Shall Prepare The Inspection Report And Certificate Of Delivery Completion To Be Signed By The Regional Inspection Team. B. Obligations Of The Supplier B.1. Delivery And Documentation 1. The Supplier Commits To Deliver The Pesticide Requirements Upon Receipt Of The Notice To Proceed/purchase Order To The Nfa’s Delivery Site In Accordance With The Technical Specifications. 2. Upon Delivery Of The Goods To The Project Site, The Supplier Shall Notify The Procuring Entity And Present The Following Documents To The Procuring Entity: A. Original And Four Copies Of The Supplier’s Invoice Showing Goods’ Description, Quantity, Unit Price, And Total Amount; B. Original And Four Copies Of Delivery Receipt Detailing Number And Description Of Goods; C. Original And Four Copies Of The Manufacturer’s And/or Supplier’s Warranty Certificate; B.2. Packaging 1. The Supplier Shall Provide Such Packaging Of The Goods As Is Required To Prevent Their Damage Or Deterioration During Transit To Their Final Destination, As Indicated In This Contract. The Packaging Shall Be Sufficient To Withstand, Without Limitation, Rough Handling During Transit And Exposure To Extreme Temperatures, Salt, And Precipitation During Transit, And Open Storage. Packaging Case Size And Weights Shall Take Into Consideration, Where Appropriate, The Remoteness Of The Goods’ Final Destination And The Absence Of Heavy Handling Facilities At All Points In Transit. 2. The Packaging, Marking, And Documentation Within And Outside The Packages Shall Comply Strictly With Such Special Requirements As Shall Be Expressly Provided For In The Contract. 3. The Outer Packaging Must Be Clearly Marked On At Least Four (4) Sides As Follows: A. Name Of The Procuring Entity B. Name Of The Supplier C. Gross Weight D. Any Special Lifting Instructions E. Any Special Handling Instructions F. Any Relevant Hazchem Classifications 4. A Packaging List Identifying The Contents And Quantities Of The Package Is To Be Placed On An Accessible Point Of The Outer Packaging If Practical. If Not Practical The Packaging List Is To Be Placed Inside The Outer Packaging But Outside The Secondary Packaging. B.3. Insurance 1. The Goods Supplied Under This Contract Shall Be Fully Insured By The Supplier In A Freely Convertible Currency Against Loss Or Damage Incidental To Manufacture Or Acquisition, Transportation, Storage, And Delivery. The Goods Remain At The Risk And Title Of The Supplier Until Their Final Acceptance By The Procuring Entity. B.4. Transportation 1. The Supplier Is Required Under This Contract To Transport The Goods To The Designated Delivery Site, Including Insurance And Storage, As Shall Be Specified In This Contract, Shall Be Arranged By The Supplier, And Related Costs Shall Be Included In The Contract Price. 2. The Nfa Accepts No Liability For The Damage Of Goods During Transit. Suppliers Risk And Title Will Not Be Deemed To Have Passed To The Nfa Until Their Receipt And Final Acceptance At The Final Destination. B.5. Intellectual Property Rights 1. The Supplier Shall Indemnify The Nfa Against All Third-party Claims Of Infringement Of Patent, Trademark, Or Industrial Design Rights Arising From The Use Of The Goods Or Any Part Thereof.
