Eligibility Requirements Of Prospective Bidders ● Dti/sec/cda Registration ● Valid Mayor’s/business Permit Issued By Their Local Government Unit In The Current Year ● Current Bir Registration With Official Receipt / Tax Clearance ● Philippine Government Electronic Procurement System Accreditation (philgeps) Certificate Of Registration. ● Willingness To Accept Check Payment With A Bank Account Named After The Name Of The Business. Iii. Approved Budget For The Contract The Approved Budget For The Contract Is Eight Hundred Thousand Pesos (php800,000.00) Inclusive Of Vat. Iv. Scope Of Work The Procurement Includes The Purchase And Delivery Of One Hundred Sixty (160) Sari-sari Store Business Kits With A List Of The Identified Commodities In The Request For Quotation (rfq) For The Following Lgus: Specifications Per Package Of The Sari-sari Store Business Kits Amounting Each To P5,000.00: All Goods Or Items Should Be Delivered At The Municipal Hall Of Each Lgu At The Date Indicated In Annex 1, To Be Confirmed By The Dti-nueva Ecija Project-in-charge. All Items Should Be Labeled Or Numbered For Each Package Based On The Entitlement Of Each Beneficiary. All Other Delivery Expenses Like Repacking, Handling, Trucking And Other Incidental Expenses (which Includes The Delivery Of Items To The Subject Locations Within The Municipality) Are Included In The Approved Budget For The Contract (abc). Expired Or Damaged Goods Should Be Replaced One (1) Week Upon Receipt Of Notice. It Is Also Subject For Inventory And Inspection By The Dti-nueva Ecija Property Inspector And Supply Officer. V. Schedule Of Payment Payment Will Be Done Upon Complete Delivery Of The Project At The Designated Time And Place, Submission Of All Necessary Documents And Subject To Coa Auditing Rules And Procedures. Vi. Instructions The Supplier Shall, Within Fifteen (15) Working-days From The Receipt Of The Notice To Proceed (ntp), Comply With The Following Instructions: A. Deliver The Procured Items To The Place And Date Coordinated With The Dti Nueva Ecija Project Focal Person/s. B. Ensure That Goods Delivered Are Included In The Dti List Of Necessities And Prime Commodities, And All In Good Conditions, Free Of Damages/not Adulterated/diluted. C. Warrant That The Expiration Of Goods Is At Least A Minimum Of One (1) Year Upon Delivery. However, The Supplier Is Not Precluded To Make An Earlier Delivery. Vii. Replacement Clause The Supplier, At The Time Of Delivery And Under Normal Conditions, Guarantees: (1) The Goods Supplied Are In Good Condition, (2) In Case Of Food, The Goods Are Not Spoiled Nor About To Expire Or About To Reach Its Expiry Date And Are Safe For Human Consumption, And (3) In Case Of Spoiled/diluted/adulterated Goods, The Immediate Replacement Of Said Goods Shall Not Be More Than One Week After Notification By Dti. Viii. Penalty Clause If The Supplier Fails To Satisfactorily Deliver Any Or All Of The Goods And/or Perform The Services Within The Period Specified In The Contract Inclusive Of Duly Granted Time Extensions, If Any, The Dti Shall Impose Liquidated Damages At Least Equal To The One Tenth Of One Percent (.001%) Of The Cost Of The Unperformed Portion For Every Day Of Delay Until Actual Delivery Of Performance. Ix. Contract Termination The Dti May, At Any Given Time, Terminate The Contract For Breach Of Any Of The Provisions Thereof And Other Legal Causes By Serving A Written Notice To The Other Party At Least 30 Days Before The Intended Date Of Termination. X. Reservation Clause In Accordance With Sec. 41 Of The Revised Irr Of Ra 9184, The Procuring Entity Reserves The Right: (1) To Reject Any Or All Bids, (2) Declare A Failure Of Bidding, (3) Annul The Bidding Processor, Or (4) Not Award The Contract In Any Case Stated In The Abovementioned Section Of The Procurement Act, Without Thereby Incurring Any Liability To The Affected Bidder Or Bidders If The Funds/allotment For The Program/project/activity Has Been Withheld Or Reduced Through No Fault Of The Dti. Xi. Dispute Resolution A. Should Any Dispute Related To The Contract And/or Rights Of The Parties Arise, The Same Shall Be Submitted To Mutual Consultation, Mediation And Arbitration, In The Order Of Application. The Venue Of The Proceedings Shall Be In The City Of San Fernando, Pampanga. B. In Case Of A Court Suit, The Venue Shall Be The Courts Of Competent Jurisdiction In The City Of San Fernando, Pampanga, To The Exclusion Of All Other Courts; And C. Any Amendment Or Additional Terms And Conditions To The Contract Must Be In Writing, Signed And Acknowledged By The Parties.
