Description I. Objective To Procure A Security Service Provider For The Purpose Of Safeguarding And Protecting Dti-bois Property, Equipment, Facilities, Installations And Confidential Information As Well As Its Officers, Employees, Visitors, Clients And All Persons Transacting With Boi Offices/services. Ii. Approved Budget For The Contract (abc) The Approved Budget For The Contract For Three (3) Years Is Twenty Five Million Two Hundred Sixty Four Thousand Seven Hundred Twenty And Eighty Three Centavos (php 25,264,720.83). Breakdown Of Expenses: No. Of Guards Total Approved Budget Remarks Sixteen (16) Guards Php 25,264,720.83 Boi-funded Iii. Scope Of Work The Security Service Provider Shall: 1. Provide Security Services To Boi For Three (3) Years From Receipt Of Notice To Proceed. It Shall Effectively And Continuously Safeguard And Protect Boi Officials, Employees, And Guests From Harm, Injury And All Forms Of Violence, Its Premises And Properties From Theft, Pilferage, Robbery, Arson, Damage, Loss, Trespass, And Other Unlawful Acts By Any Person. It Shall Also Enforce The Approved Security Plan And Existing Office Rules And Regulations Including Those Which The Boi May Promulgate From Time To Time. 2. Provide The Boi With Qualified, Licensed, Bonded, Uniformed And Highly Trained Security Guards Who Shall Guard And Protect The Officials, Employees, Properties And Premises Of The Boi As Specified In The Previous Paragraph Twenty Four (24) Hours Daily, Including Saturdays, Sundays And Holidays, And Who Shall Be Posted And Distributed In Accordance With The Boi Schedule Of Guard Assignment. The Security Guards Shall Possess The Qualifications Prescribed Under Republic Act No. 11917 (an Act Strengthening The Regulation Of The Private Security Services Industry),“ Such As But Not Limited To The Following: A. Filipino Citizen Not Less Than Twenty-one (21) Years Old; B. In The Case Of Male Security Guards, At Least Five (5) Feet And Five (5) Inches Tall, Not Less Than 135 Pounds Nor More Than 180 Pounds In Weight. In The Case Of Female Security Guards, At Least Five (5) Feet And Two (2) Inches Tall, Not Less Than 100 Pounds Nor More Than 160 Pounds In Weight; C. At Least High School Graduate; D. With At Least Five (5) Years Security Job Experience. In Case The Job Experience Is Less Than Five (5) Years, The Security Service Provider Has To Submit Justifications For Hiring Such For Boi Consideration. 52 E. Of Good Moral Character, Cleared By Major Law Enforcement Agencies, And Never Convicted Of An Offense Involving Moral Turpitude; F. Duly Licensed And Trained As A Professional Security Guard And Must Possess Clearance From The National Bureau Of Investigation (nbi) And The Philippine National Police (pnp); G. Must Have Passed A Drug Test, Neuro-psychiatric And Psychological Examination And Evaluation At Least Six (6) Months Prior To Assumption Of Duty; H. Does Not Suffer From Any Physical And Mental Defects Or Deformities; And I. Such Other Qualification/s, Which Boi May Specify From Time To Time Through Written Notice To The Agency. 3. Provide The Boi With The Profile Of Each Security Guard To Be Assigned At Boi. 4. Absorb Existing Security Guards Assigned At Boi Upon The Execution Of The Contract Of Security Service, As May Be Recommended By Boi. 5. Ensure That All Security Guards Shall Follow The Existing Rules And Regulations And Those, Which The Boi May Issue From Time To Time. 6. Discipline, Supervise And Control Its Security Guards In Accordance With Republic Act No. 11917 (an Act Strengthening The Regulation Of The Private Security Services Industry) 7. Replace Any Security Guard Within 72 Hours Upon Written Request By Boi Due To, But Not Limited To Unsatisfactory Performance. 8. Equip On Its Account, And Without Deducting The Cost To The Salaries Or Benefits Of The Security Guard, And Other Expense Items That Should Be Charge To The Agency By Law And Other Issuances, Firearm And Ammunitions, Equipment And Other Paraphernalia Whenever On Duty As Prescribed By Pertinent Laws And Regulations, As Follows: A. 9 Mm Pistol With Ammo Loaded With 1 Extra Clip (4) B. Handheld Radio Transceivers With Individual Chargers, Headset, Microphone And Spare Battery Pack (uhf (preferred) Or Vhf Capable) C. Reflectorized Traffic Vests (2 Pcs) D. Bullhorn (2 Pcs) E. Ostrich Mirror (1 Pc) F. Raincoats (2 Pcs) G. Steel Baton (6 Pcs) H. Rain Boots (4 Pairs) I. Metal Detector (2 Pcs) J. Heavy Duty Umbrellas (2 Pcs) K. 1.rechargeable Search Light (2 Pcs) L. Shotgun With 12 Extra Round Of Ammunition (1 Pc) M. Firearms Vault (1 Pc) N. Handheld Radio (9 Units) 9. Inspect And Maintain Adequate Control Of All Incoming And Outgoing Persons, Including Vehicles, Containers, Bags And Properties Entering And Leaving Boi Premises. 10. Prevent Entry Of Unauthorized Persons To Boi Premises. If This Cannot Be Done, Report The Same To Boi Management For Proper Action/ Advice. 11. Automatically Conduct Investigation In Cases Of Breach Of Security By Any Person Within Boi Premises Including Commission Of Crimes Against Person Or Property And To Submit An Initial Report Within 24 Hours From The Happening Thereof. 12. Be Responsible For Any Loss Or Damage Incurred By Boi, Its Officials And Employees Which Are Due To The Fault Or Negligence Of The Security Guards Even If Such Fault Or Negligence Is Found To Be Contributory Upon Determination By Boi After Due Process. In Case Of Such Loss Or Damage, Written Notice Concisely Describing The Loss Or Damage Should Be Given To Boi Within Twentyfour (24) Hours From The Time Of Occurrence Or Discovery. Replacement/payment Of The Lost Item Shall Be Made Within Thirty (30) Days Upon Establishment Of Direct Or Contributory Fault Or Negligence On The Part Of The Concerned Security Guard. 13. Assume Full Responsibility For Any Loss Or Damage To Boi Guests Or Third Parties For Property Received And Placed Under The Custody Of The Security Guards When Such Loss Or Damage Is Due 53 To The Fault Or Negligence Of The Guards Or Their Actions Contributed To The Cause Of, Or Aggravated The Loss Or Damage To Such Property. 14. Hold Boi Free From Any Claim Arising Out Of Unpaid Wages/ Benefits Due Or Of Personal Injury, Death, Damages Caused By Any Security Guard To Himself, Or To Others, Whether Or Not The Same Arose Out Of Or In The Performance Of Duties. In The Event The Boi Shall Be Liable For Failure Of The Security Service Provider To Act Immediately On Any Of The Above Claims For Which The Security Service Provider Is Liable Under The Law, Boi Shall Be Entitled To Deduct Any And All Amount That It May Have Been Called Upon To Pay From The Monthly Service Fees Due The Winning Bidder. 15. Submit To Boi A Contingency And Emergency Plan In Case Of Unrest, Public Disorder And Natural Calamities Within 30 Calendar Days From The Effectivity Of The Contract Of Security Service. 16. The Security Service Provider Shall, At All Times, Maintain A Daily Logbook At All Guard Posts Where Daily Events Are Entered And Which Shall Always Be Available For Inspection By Any Authorized Personnel Of Boi. 17. Maintain A Satisfactory Level Of Performance Throughout The Term Of The Contract Of Security Service Based On A Prescribed Set Of Performance Criteria Which Shall Include, Among Others, The Following: Quality Of Service Rendered, Time Management, And Provision Of Regular Progress Reports. 18. Assign A Roving Inspector From The Main Office To Monitor Posted Security Guards To Determine On Whether They Are Performing Their Duties And Responsibilities. The Inspector Shall Submit A Monthly Report To Boi; 19. Pay The Salaries, Benefits And Other Incentives And Allowances Of All Security Guards, In A Timely And Efficient Manner Including Payment Of Separation, And/or Retirement Benefits In Accordance With Existing Laws, Rules And Regulations. 20. Comply With Pertinent Provisions Of All Relevant Laws Such As, But Not Limited To, The Labor Code, Section 9 Of Republic Act No. 11917 (an Act Strengthening The Regulation Of The Private Security Services Industry), 13th Month Pay, Pd No. 351, Minimum Wage Law, Philhealth, Social Security Law And The Employees Compensation Act. It Is Understood That The Security Service Provider Is An Independent Contractor And Therefore, There Is No Employer-employee Relationship Between Them And The Boi. Note: Section 9 Of Ra No. 11917 Refers To The Minimum Administrative Fee That May Be Charged By Psas To Its Clients Which Shall Not Be Less Than Twenty (20%) Of The Total Contract Cost. Iv. Supplies, Materials, Tools And Equipment A. The Contractor Shall Provide/purchase, On Its Own Account, All Supplies, Materials, Tools And Equipment Necessary, Appropriate And Incidental To The Performance Of The Job. B. All Firearms Must Be Presented During The Initial General Information. Firearms Should Be In Good Condition With Complete Load Of Ammunition. C. No “paltik” (danao Made) Or Improvised Firearms Shall Be Issued To The Security Guards. D. Boi May Request Canine Dogs As Needed. V. Schedule Of Requirements Hours Detailed Starting Hours 12 Hours Total Of 16 Guards: Monday To Friday (day Shift) – 5 Guards (basement, Parking 2, Backdoor, Entrance, 3rd Floor) 54 Vi. Contract At The Time A Service Provider Is Chosen, Boi Will Enter Into A Contract With The Winning Bidder Indicating The Terms And Conditions Stipulated In The Tor. Vii. Contract Duration The Service Contract Shall Be Effective For A Period Of Three (3) Years From Receipt Of Notice Proceed. Viii. Penalty Clause The Security Agency, Security Officer And Guards Shall Be Penalized For Failure To Comply With The Applicable Provisions Of Ra 11917 ( An Act Strengthening The Regulation Of The Private Security Services Industry). Ix. Liquidated Damages If The Security Service Provider Fails To Satisfactorily Deliver Any Or All Of The Goods And/or Perform Their Services Within The Period Specified In The Contract Inclusive Of Duly Granted Time Extensions If Any, The Boi Shall Impose Liquidated Damages Shall Be At Least Equal To One-tenth Of One Percent (0.001) Of The Cost Of The Unperformed Portion For Every Day Of Delay. Once The Cumulative Amount Of Liquidated Damages Reaches Ten Percent (10%) Of The Amount Of The Contract, The Procuring Entity May Rescind Or Terminate The Contract, Without Prejudice To Other Courses Of Action And Remedies Available Under The Circumstances. X. Termination Of Contract The Boi May, At Any Given Time, Terminate The Contract For Security Services For Breach Of Any Of The Provisions Thereof And Other Legal Causes By Serving A Written Notice To The Other Party At Least Thirty (30) Days Before The Intended Date Of Termination. Xi. Confidentiality Clause All Information, Data And Documents And Concerning The Business And Affairs Of The Boi Which Are Classified As Confidential Shall Be Treated With Extreme Secrecy By The Security Agency, Officers/guards And Shall Not Be Communicated Or Disclosed To Any Person Or Entity Without Prior Written Clearance From Boi. Xii. Retention Of Existing Security Guards The Winning Bidder Shall, Upon Evaluation/determination By Boi, Absorb The Existing Security Guards. Xiii. Terms Of Payment A. Winning Bidder Will Prepare Monthly Billings For Boi. Monday To Saturday (day Shift) – 1 Guard (2nd Floor) Monday To Sunday (day Shift) – 5 Guards (parking 1, Lobby, 4th Floor, Cctv And Detachment Supervisor (ds) Monday To Sunday (night Shift) – 5 Guards (lobby, Parking, 4th Floor, Cctv Operator, And Shift-in-charge (sic) 55 B. Payment Shall Be Made Through Land Bank’s Lddap-ada/bank Transfer Facility, After Submission Of Service Billing Invoice And User’s Certificate Of Acceptance Of The Service Performed. Bank Transfer Fee Shall Be Charged Against The Creditor’s Account If Any.
