If The Successful Bidder Fails To Deliver Within The Prescribed Period, The Bids And Awards Committee, Shall Impose Either Of The Following Penalties: A. A Liquidated Damage In The Amount Equivalent To One Tenth Of One Percent (0.1%) Of The Total Value Of The Contract/purchase Order For Each Day Of Delay On The Delivery/completion Of Services Or The Undelivered Portion Thereof. B. Award To The Next Lowest Calculated Responsive Bidder Or Highest Rated Responsive Bidder The Procurement Of The Supplies It The Successful Bidder Failed To Deliver And To Charge Him The Excess In Price, If Any. In Either Case, The Head Of The Bac-secretariat Upon Recommendation Of The Bids And Awards Committee Shall Collect The Value Of The Penalty Imposed Herein From The Concerned Bidder And Form Part Of The Found Of The Bids And Awards Committee. 9. No Bid Security Shall Be Returned To Bidders After The Opening Of Bids And Before Contract Signing/issued Of Purchase Validity Period Of One Hundred Twenty (120) Calendar Days From The Date Opening Of Bids. 10.
