Terms Of Reference Revenue Administration And Project Management Support Consultant Background Tax Reforms The Government Of The Solomon Islands (government) Is Undertaking A Number Of Reforms To Increase Domestic Resource Mobilization In Solomon Islands. A Tax Administration Bill Is Progressing Through Parliament And A Value Added Tax (vat) Bill Will Be Introduced Later This Year. In 2022, The Government Will Review And Simplify The Income Tax Act. These Changes Will Introduce A Common Administrative Approach Across All Tax Acts, A Fundamental Change In Indirect Taxes, And Self-assessment On A Much Broader Basis Than Exists Now. These Are Significant Changes For Staff Of The Inland Revenue Division (ird) And Taxpayer Customers That Will Also Require Significant System Changes To Support Their Implementation. Low Organisational Capability. In Addition To The Impending Changes To The Tax Legislative Framework, The Pacific Financial Technical Assistance Center (pftac) Has Undertaken Many Assessments Of The Organizational Issues Within The Ird. Pftac’s Analysis Shows That There Is A Gap Between The Existing And Required Levels Of Performance Of Ird Across A Range Of Areas, And In The Structure Of The Organization. This Includes But Is Not Limited To Human Resources Development Including Recruitment And Gender Policies, Leadership Development, Training, Tax Technical Skills, Ict Skills, Internal And External Communications, And Change Management Ability. Pftac Has Provided Some Advice On An Appropriate Restructure Of Ird And Ird Has Begun To Implement These Changes. In Addition, Ird Has Also Started Some Leadership Training Of Its Senior Staff And Started A Program To Upskill Its Officers In Technical Tax Skills. Existing System Aged And Becoming Obsolete. The Existing Tax Administration Information System (tais) Was Introduced To Ird In 2005 And Upgraded In 2012. It Has Some Modifications Implemented Since Then Including The Introduction Of A Module For Online Filing And Payment But It Is Struggling To Cope With Daily Business Processes And It Is Uneconomical To Continue To Fix The Issues Arising On An Ad-hoc Basis. Additionally, There Is A Large Gap In Management Information Reporting As This Is Not Easily Extractable From The Existing System. The Government Has Started A Process To Procure An Upgraded Tais. Business Processes Undocumented. Even In The Present Environment, There Is A Critical Lack Of The Understanding And Documentation Of The Key Processes Ird Undertakes. This Leads To Difficulties In Training New Staff, Cross-skilling Existing Staff, Identifying And Fixing Process Errors And Business Process Improvement. To Implement A New Tais, Current And Future Business Processes Must Be Researched, Documented And Training Provided To Support Their Effective Implementation. Large Debt Book And Poor Filing Rates. Existing Debt Is Beyond A Manageable Level And While There Have Been Some Recent Improvements Achieved With The Help Pftac, This Will Require Much More Concentrated Support To Make A Sustainable Long-term Improvement. There Is Little Understanding Of The Current Debt And Return Strategy, What It Contains Or How To Implement The Prioritization And Organization Of Work Required To Reduce Debt. Return Filing Rates Are Poor With Income Tax Filing Rates Having Fallen Below 20% For A Number Of Years And Trending Downwards. A Further Issue Is That Poor Data Integrity Impacts On The Size Of The Debt Stock. Audit Capability. Taxpayer Audit Has Traditionally Been Supported By Donor Agencies. As A Result, It Has Achieved Performance Improvements And Now Assesses And Collects A Significant Proportion Of The Overall Tax Revenue. There Are Still Some Outstanding Areas Which Need Attention, Including The Effective Use Of The Tais All Audit Staff And The Understanding Of And Therefore Adherence To Policies And Processes. The Asian Development Bank (adb) Is Committed To Supporting The Government’s Goals Of Reforming And Simplifying Their Tax System, Improving Operational Capability, And Updating The Existing Tais. In This Regard, A Project Financed By Adb And The Governments Of Australia And New Zealand Will: Continue The Restructuring Reforms Of Ird. This Will Require A Comprehensive Plan, Workforce Analysis, Designing And Introducing New Business Processes, Working With The Tais Vendor To Match Business Processes To The Upgraded Tais, Regular Communication To Staff Of The Rationale For Change, Managing Staff Who May Find The Change Difficult, Training Of Staff, And Being Flexible To Make Changes To The Approach Along The Way. Specific Consideration Will Be Given To Ensure Women Have Opportunities To Advance Their Careers In Ird. Training Will Also Have To Be Given To Other Government Agencies Such As The Customs And Excise Division Who Collect Some Taxes On Behalf Of Ird. Ird Will Procure An Upgraded Tais. The Upgraded Tais Will Have Expanded Functionality, I.e., Improve Management Reporting, Add A Vat Module, Collect Sex-disaggregated Data, And Incorporate The Latest Security Features To Improve The Integrity Of The Tax System And Help Prevent Fraud. The Tais Provider Will Be Required To Provide Comprehensive Training To Ird Staff To Utilize The Upgraded Tais And Ensure There Is Compatibility With Other Government Systems Such As The Custom And Excise Division’s Computerized Information System And The Ministry Of Finance And Treasury’s Financial Management Information System. The Project Will Also Fund The Acquisition Of New Associated Hardware And Equipment. The Revenue Administration And Project Management Support Consultant, In Concert With Ird, Will Be Required To Work With The Tais Vendor To Ensure The Organizational Changes Are Aligned To The Tais Requirements. With Significant Changes To The Tax Administrative Arrangements And The Introduction Of A Vat, A Comprehensive Taxpayer Education Program Will Be Rolled Out To Individuals, Businesses, And Others Such As Tax Agents. Ird And The Revenue Administration And Project Management Support Consultant Will Design The Outreach Program And Deliver It. Specific Attention Will Be Given To Women Taxpayers, Including Women Micro And Small Entrepreneurs. The Revenue Administration And Project Management Support Consultant Will Be Required To Conduct A Survey At The Beginning And End Of The Project To Assess If Taxpayers Have Had Improved Experiences With Ird. Objectives Of The Assignment The Government Will Engage The Services Of An Experienced Consulting Firm To Provide Taxation Consulting And Project Management Services To Assist With The Reform, Restructure, And Modernization Of The Ird; Supporting The Upgrade Of The Tais; And Delivering A Comprehensive Taxpayer Education Program. The Consultants Engaged By The Firm Shall Undertake The Following: Provide Taxation And General Advisory Services To Ird Business Activities Such As Process Improvement, Change Management, Tax Technical Areas, Business Intelligence Functions, Human Resources, Gender, And Social Issues. In Partnership With The Chosen Supplier, Design, Test And Implement An Upgraded Tais, And Support The Ird In Its Management Of The Contract With The Tais Vendor. Liaise And Work With Other Ministry Of Finance And Treasury Divisions Or Other Government Agencies To Ensure Smooth Implementation Of The Project I.e., The Economic Reform Unit, Customs And Excise Division, And The Information Communication Technology Support Unit. Support Improved Communications With Taxpayers, Especially To Support The Planned Changes, And The Provision Of Better Customer Services, Including For On-line, Email, Telephone And In-person Enquiries. Undertake A Baseline Survey And An Endline Survey To Assess Taxpayers’ Satisfaction With Ird. Implement The Administrative Changes Made In The Tax Administration Act, The Value Added Tax Act, And The Revised Income Tax Act (income Tax Policy Work Is Due To Start In 2022). Develop And Oversee Delivery Of Both Tax Technical And General Training As Required By The Updated Legislation And System Changes. Implement Both Quality Management And Compliance Improvement And Risk Control Frameworks To Ird. Provide Legal And Technical Support To Ird For Both The Implementation Of New And Updated Tax Regimes And The Ongoing Business Needs As Required, Including Supporting The Audit And Large Taxpayer Areas. Provide Suitable Training And Capacity Building For All Ird Staff In The Activity Areas Outlined. Review Debt And Return Collection And Provide Guidance On How To Improve The Capability Of Staff And Better Manage These Activities. Ensure Other Project Activities Such As The Gender Action Plan Are Implemented And Reported On As Appropriate. Generally Manage The Project Including Liaising With The Project Director On A Regular Basis, Preparing Regular Project Implementation Reports, Instituting Sound Financial Management Practices And Ensuring Project Funds Are Audited, And Act As The Secretariat For The Project Steering Committee. The Selected Firm Will Be Required To Provide The Above Services Over A Period Of Five Years And Extendable Subject To Adb And Ird Recommendation. The Selected Firm Will Work Jointly With The Commissioner Of Ird And Ird Director Of The Project In This Scope And Prepare Reports From Time To Time. Adb Requires An Estimated Total Of 320 Person-months Of International Experts And 60 Months Of A National Expert. Six Of The Experts Will Be Full-time Based In Honiara, Solomon Islands, For The Duration Of The Assignment. Two Of The International Experts Will Be Required To Provide Intermittent Inputs In Honiara And Their Home Base. The Assignment Is Expected To Start In The First Quarter Of 2022. The Terms Of Reference May Be Revised According To Changes And Or Additional Requirements Identified During Implementation. Summary Terms Of Reference For Each Specialist Are Set Forth In Paras. 14–21. Team Leader/change Advisor (international, 60 Person-months, Full-time) Shall Undertake The Following Tasks: With The Ird Executive, Lead The Work Program To Implement The Restructure Of Ird. The Ird Restructure Will Require A Comprehensive Plan, Including Annual Plans; Workforce Analysis; Regularly Communicating With Staff; And Managing Staff Who Find The Changes Difficult. With The Ministry Of Finance And Treasury Corporate Staff And Ird Human Resource Staff, Prepare Position Descriptions And Other Organizational Documents To Ensure The New Structure Is Approved By The Ministry Of Public Service. Roll Out The Restructure Including Physical Office Changes And Moving Staff As Required. With The Ministry Of Finance And Treasury Corporate Staff And Ird Human Resource Staff, Design And Implement A Training Program For Ird Staff In Their New Roles. Provide Leadership Coaching And Support To The Ird Executive (primarily) And The Wider Leadership Team. Provide Advice, On-the-job Support, Training, And Capacity Building For Ird Staff As Appropriate. Provide Specialist Support For Two Key Ird Counterparts; Communications Specialist And Management Advisor (existing Ird Positions). Provide Operational Planning Coordination And Support To The Ird Executive. Ensure That The Taxpayer Education Program Is Designed And Effectively Rolled Out. Ensure That The Baseline And Endline Surveys On Taxpayer Experiences With Ird Are Designed And Delivered. Provide Leadership And Oversight Of A Team Of International Consultants, Including The Planning And Prioritization Of Work And Ensuring Its Delivery. Undertake Or Coordinate The Functions Of A Project Management Unit Through A Combination Of Personal Effort And Coordination Of In-line Staff From Ird And The Ministry Of Finance And Treasury. Meet All Reporting Requirements For Ird, Adb, And Any Other Key Stakeholders As Required, Reporting On A Day-to-day Basis To The Project Director. Be The Primary Point Of Contact For The Project Steering Committee And Provide All Documents Necessary To Ensure The Project Steering Committee Can Make Decisions And Is Aware Of Project Implementation Progress. Provide Oversight And Management Of All Internal And External Communications Planning And Management, Public Relations Management, And Donor Liaison. Ensure There Is Sufficient Financial Management Oversight Of The Project (including Ensuring Project Statements Are Prepared And Then Audited), Assist In Giving Advice And Support To The Executive Team About Operational Budget Management. Work With The Project Coordinator To Prepare Periodic Reports To Ird Management, Adb, Australia, And New Zealand. Work With The Project Coordinator To Ensure The Monitoring Of The Design And Monitoring Framework. Legal And Technical Advisor (international, 60 Person-months, Full-time) Shall Undertake The Following Tasks: Provide Legal And Policy Support To The Ird Commissioner, Ird Lawyer, Economic Reform Unit Policy Officers, And Other Areas As Needed. Draft Public And Private Rulings And Commissioner’s Rules. Support Necessary Consultations On The Public And Private Rulings And Commissioner’s Rules To Ensure They Are Legitimate Legal Instruments Review The Taxpayer Appeals System And Make Recommendations On Its Improvement. If Necessary Approvals Are Given To Revise The Taxpayer Appeals System, Prepare A Workplan For Its Implementation. Implement The Approved Revised Taxpayer Appeals System Workplan. Liaise With The Attorney-general’s Chambers To Ensure Ird’s Legal Instruments Are Lawful. Support The Tais Quality Assurance Advisor And Work With The Tais Vendor To Ensure That The Upgraded Tais Meets All The Legislative And Other Requirements. Contribute To A Training Program For Ird Staff To Continuously Improve Their Tax Technical Knowledge. Contribute To The Design Of A Taxpayer Education Program With A Focus On Individuals, Firms, And Others’ Legal Obligations. As Part Of A Broader Taxpayer Education Program, Liaise With Stakeholders Including Tax Agents On Technical Matters. Provide Advice, On-the-job Support, Training, And Capacity Building For Ird Staff As Appropriate. Support The Economic Reform Unit To Design And Draft Proposals To Amend Current Legislation And Regulations As Required. Minimum Requirements: The Consultant Must Have At Least Five Years Of Experience In Working With Donor-funded Projects, A Tertiary Degree, And Fluency In Both Spoken And Written English And (melanesian) Pidgin. Knowledge And Skills In Taxation And Legal Processes In Solomon Islands Would Be An Advantage. The Government Will Engage The Services Of An Experienced Consulting Firm To Provide Financial, Accounting, And Taxation Consulting Services To Assist With The Reform And Modernization Of The Ird. Selection Of The Revenue Administration And Project Management Support Consultant Will Be Through A Quality- And Cost-based Selection (qcbs) Method With Quality-cost Ratio Of 90:10 And A Full Technical Proposal. The Short-listed Firms Who Have Submitted A Proposal May Be Required To Attend An Interview. The Request-for-proposal Will Have More Details On This. Output Requirements The Consultant Shall Provide The Above-referenced Outputs And Shall Present Them To Ird. The Deliverables As Identified Below Are Subject To The Satisfaction Of Ird. Annual Workplans Report (4 Copies Of Hard Copy And A Digital Copy Sent Through Email) To Be Delivered At The Start Of Each Calendar Year Following Formal Approval By The Steering Committee. Mid-term Report Report (4 Copies Of Hard Copy And A Digital Copy Sent Through Email) Within 30 Months Of Mobilizing To Solomon Islands. Endline Survey Report (4 Copies Of Hard Copy And A Digital Copy Sent Through Email) Within 60 Months Of Mobilizing To Solomon Islands. Final Report Report (4 Copies Of Hard Copy And A Digital Copy Sent Through Email) Within 60 Months Of Mobilizing To Solomon Islands. Quarterly Reports Report To Be Delivered Through Email. To Be Delivered Every 3 Months From Mobilizing To Solomon Islands. All Reports Must Be Submitted To: Project Director, Ird Deputy Commissioner (operations), Ministry Of Finance And Treasury Compound, Po Box G9, Mendana Avenue, Honiara. Counterpart Support Ird Will Provide Furnished Office Space (with Free Electricity And Potable Water) That Can Accommodate Up To Six Personnel.
