The subject of the Order is the delivery of brand new LED fluorescent lamps. Transport at the expense and risk of the Supplier (ul. Gazowa 6, 20-406 Lublin) within 5 days from the date of sending the order. Payment method: bank transfer within 30 days from the date of receipt of the subject of delivery together with the invoice. 1. The Supplier declares that the supplied materials meet the technical requirements, and in particular: A) meet all the features specified in the inquiry, B) are brand new. 2. The Ordering Party reserves the right: A/ to terminate the procedure without making a choice and without giving a reason, or to invalidate the procedure; B/ to change the terms of the procedure before the deadline for submission of offers; C/ after the end of the inquiry, to start stage II in the form of a discount auction. D/ to freely choose an offer. 3. All Information Provided By Bidders Will Be Treated As Confidential And Will Not Be Made Publicly Available In Any Way. 4. The Contractor Undertakes To Pay The Ordering Party A Contractual Penalty For: A) Delay In Execution Of The Subject Of Delivery In The Amount Of 0.1% Of The Supplier's Remuneration For Each Day Of Delay, B) Withdrawal By The Supplier From The Contract For Reasons For Which The Ordering Party Is Not Responsible In The Amount Of 5% Of The Contractor's Remuneration. C) Withdrawal By The Ordering Party From The Contract For Reasons For Which The Supplier Is Responsible In The Amount Of 5% Of The Contractor's Remuneration 5. The Contractor Provides A 12-Month Warranty. 1) The Warranty Period Runs From The Date Of Acceptance Together With The Invoice. 2) Warranty liability consists in the removal by the Contractor of faults and defects arising during the Warranty Period at his own expense and risk or his covering the costs incurred by the Ordering Party due to the removal of faults and defects on his own or commissioned to another Contractor (substitute performance). 3) In the event of a complaint being accepted, the Contractor is obliged to eliminate the causes of the incorrect work within a period not longer than 3 working days from the date of receiving information about the defect. 4) The Contractor shall pay the Ordering Party a contractual penalty for late performance of the warranty repair in the amount of PLN 400 for each day of delay) 6. The following are excluded from the warranty: 1) Damage resulting from improper use or repair by unauthorized persons, with the exception of repairs performed as part of substitute performance. 2) Damage resulting from vandalism and railway accidents, which occurred without the fault of the Contractor.
