1. The subject of the Order is the Implementation of the Task entitled "Purchase of Street Cleaning Equipment for the Mała Wieś Commune" 2. Sources of funding: 2.1. The subject of the Order was co-financed from the budget of the Mazowieckie Voivodeship as part of the Task "Mazowsze for Clean Air 2023". 2.2. Pursuant to Art. 310 of the Public Procurement Law, the Contracting Authority indicates that it may invalidate the contract award procedure if the funds which the Contracting Authority intended to allocate to finance the whole or part of the contract under the above-mentioned Funding Sources Have Not Been Granted. 3. A detailed description of the Subject of the Order is contained in this ToR, and in particular in Annex No. 1 "Description of the Subject of the Order" and the Draft Provisions of the Agreement, i.e. Appendix No. 10 "template Agreement". 4. The Ordering Party indicates that Annex No. 1 "description of the Subject of the Order" specifies the minimum required technical parameters of the delivered Subject of the Order. 5. The Ordering Party informs that when specifying the subject of the Order by indicating the Trade Names, it allows for any Market Equivalents not worse than indicated. However, the indicated Brand or Trade Name defines the Class of the Product, and not a specific Manufacturer. 6. The parameters of the Standard indicated by the Ordering Party present the Technical, Operational, Usage, Functional and Other Features relevant to the Subject of the Order. 7. The Contractor should read the Description of the Subject of the Order carefully and in detail, paying attention to whether it contains all the information necessary to perform the Subject of the Order. 8. The Contractor is obliged to perform the subject of the Agreement in accordance with the principles of modern technical knowledge, the applicable provisions of the law of the Republic of Poland, applicable technical standards, standard studies, standards, principles of construction art (understood as broadly understood professionalism, possessed experience and knowledge in the field of construction), professional ethics, maintaining due diligence and achieving high technical and aesthetic quality, which is required for the implementation of the entire draft agreement as well as the implementation of individual activities resulting from the draft agreement, within the time limit and on the terms specified in the draft agreement.
