1. Nazwa zamówienia: Świadczenie usługi całodobowego pogotowia awaryjnego dla budynków Gminy Piekary Śląskie administrowanych przez Zakład Gospodarki Mieszkaniowej w Piekarach Śląskich. 2. Przedmiot zamówienia obejmuje świadczenie usługi całodobowego pogotowia awaryjnego: 1) w nieruchomościach, których wykaz adresowy zawiera załącznik nr 1A do SWZ; 2) w zakresie, jaki obciąża Zamawiającego zgodnie z obowiązującymi przepisami prawa tj. ustawą z dnia z dnia 21 czerwca 2001 r. o ochronie praw lokatorów i mieszkaniowym zasobie gminy oraz zmianie Kodeksu cywilnego (tj. Dz. U. 2023 poz. 725 z późn. zm.) oraz ustawą z dnia 23 kwietnia 1964 r. kodeks cywilny (t. j. Dz. U. z 2024 r. poz. 1061,1237). 2.1. Ilość budynków objęta pogotowiem awaryjnym wynosi: 81. 2.2. Zamawiający zastrzega sobie prawo do zmiany zakresu przedmiotu zamówienia w przypadku zmiany ilości budynków określonych w załączniku nr 2 do niniejszej umowy z przyczyn niezależnych od Zamawiającego, wynikających np. z przekazania nieruchomości objętej przedmiotem zamówienia innemu podmiotowi w administrowanie, rozbiórki budynku, przekazanie budynku w administrowanie itp.,
