Section 3 (ii) Conditions of Particular Application (COPA) Reference to GC Clause Clause 14 Replace Clause 14 with: The Works and Routine Maintenance to be completed by the Intended Completion Date 14.1 The Contractor may commence execution of the works on the Start Date and shall carry out the Works and Routine Maintenance in accordance with the programme submitted by the contractor, as updated with the approval of the Engineer, and complete them by the Intended Completion date. Clause 33 Replace Clause 33 with: Correction of Defect noticed during the Defects Liability Period and Routine Maintenance of Roads for six years after completion of work (including defect liability period of one year). 33.1 The Engineer shall give notice to the Contractor of any Defects before the expiry of the Defects Liability Period, which begins at Completion and is defined in the Contract Data. The Defects Liability Period shall be extended for as long as Defects remain to be corrected. 33.2 Every time notice of a Defect is given, the Contractor shall correct the notified Defect within the length of time specified in the Engineer’s notice. For routine maintenance work this period will be 7 days or as specified in Engineer's notice. Claus e 34 Replace Clause 34 with: Uncorrected Defects During repair works 34.1 If the Contractor has not corrected a Defect within the time specified in the Engineer’s notice, the Engineer will assess the cost of having the Defect corrected, and recover twice of this amount from payments due to the Contractor or retention money. Note: Where in certain cases, the technical specifications provide for acceptance of works within specified tolerance limits at reduced rates, Engineer will certify payments to Contractor accordingly and the Contractor shall be bound by the same. Uncorrected Deficiencies noticed during the Routine Maintenance of Roads for six years (including defect liability period of one year) 34.2 (a) The Contractor shall execute the routine maintenance of roads, including pavement, road signs, road sides and cross drains including surface drains to the required standards and keep the entire road surface and structure in Defect free and traffic worthy condition during the entire maintenance period which begins at Completion and ends after six years (including defect liability period). 77 (i) (b) The routine maintenance activities and their frequency with performance index are tabulated below : - Sr. No. Name of Item/Activity Frequency of operations in the year Performance Index/Score for compliance 1 Restoration of rain cuts and dressing of berms as per clause 1902 of the MORD Specifications. As and when required, but at least quarterly. 5 6 Maintenance of guard rails and parapet rails as per clause 1911 of the MORD Specifications. Maintenance as and when required. 7 Maintenance of roads signs and village sign boards as per clause 1910 of the MORD Specifications. Maintenance as and when required. 5 8 Maintenance of boundary pillars and Kilo Meter stones as per clause 1912 of the MORD Specifications. Maintenance as and when required. 2 9 Cutting of shrubs and trimming of grass and weeds etc. as per clause 1914 of the MORD Specifications. As and when required, atleast quarterly. 3 10 White washing parapets
