Description The Juvenile Justice And Welfare Council (jjwc), Through The Advocacy And Communication Division (acd), Intends To Apply The Sum Of Five Hundred Thousand Pesos (php 500,000.00) As The Approved Budget For The Contract (abc) Chargeable Against The Jjwc 2024 Gaa Funds For The Hiring Of Consultancy Services For The Baseline Study On Children In The Context Of Counterterrorism Phase Ii I. Rationale Under The Issued Resolution Adopting The Neuchatel Memorandum On Good Practices For Juvenile Justice In A Counterterrorism Context, The Initial Phase Of The Baseline Study On Children In The Context Of Counterterrorism Has Been Completed. The Report Highlighted Important Issues And Concerns, Particularly The Lack Of Specialized Intervention Programs And Facilities For Children Who Were Recruited And Vulnerable To Violent Extremist Groups. It Stressed The Impact On The Protection Mechanisms Of Children With Dual Status As A Victim And Perpetrators Of Violent Extremism Under R.a. No. 9344 And R.a No. 11188. The Report Also Suggested Several Action Points To The Government To Ensure The Protection Of Children. Thus, As Planned, The Jjwc Is Now Ready To Implement Phase Ii Of The Baseline Study Focusing On The Context Of The Communist Insurgency. The Persistent Armed Conflict Between The Government And The New People’s Army (npa), The Armed Wing Of The Communist Party In The Country, Remains A Huge Problem That Heavily Affects Communities. Among The Conflict’s Impact Is The Heightened Vulnerability Of Children To Being Exploited And Recruited Into The Communist Armed Group. As Early As 2000, International Non-government Organizations Have Already Reported Cases Of Children Being Recruited By The Cpp-npa. In 2001, Child Soldiers International, Citing Government Sources And News Reports, Reported That 20% To 25% Of The Npa’s Newly Recruited Members Were Children. In Addition, According To The Same Report, Unicef Also Estimated That 3% Are Under The Majority Age. More Recently, The Armed Forces Of The Philippines (afp), In A Complaint Filed Before The United Nations, Shared That The Npa Recruited A Total Of 544 “child Warriors” Since 2010 Which They Also Expect To Further Increase. In 2022, The Commission On Human Rights, Through Its Office In Region X Also Confirmed Npa’s Recruitment Of Children Which Constitutes A Grave Child Rights Violation. Ii. Objectives Phase Ii Of The Baseline Study Aims To Gather Information And Understand The Current Situation Of Children Who Have Been Recruited And Exploited By Communist Insurgency Groups. The Study Will Also Determine The Vulnerability Of The Filipino Children To Be Recruited By The New People's Army And Take Part In The Armed Conflict Between The Npa And The Military. Specifically, The Study Will Establish Baseline Data On The Following: 1. Situational Analysis Of Children Involved In Communist Insurgency Including But Not Limited To The Following: A. Number Of Children Involved In Communist Insurgency In The Philippines, Such As, But Not Limited To, Children Recruited Into The Armed Struggle, Involved In Armed Conflict, And Voluntarily Surrendered. B. Areas (lgus) Where Cases Of Children Involved In The Communist Armed Struggle Are Prevalent C. Risk Factors That Cause Children To Be Involved Or Recruited Into The Communist Armed Struggle D. Circumstances Of The Children Particularly Those Relating To Migration Or Displacement, Gender, Disability, And Culture Issues E. Status Of Children Recruited By Cpp-npa 2. Services And Programs Available And Provided To Children Who Are Vulnerable To Or Have Been Exploited To Take Part In The Armed Struggle And Those Who Voluntarily Surrendered. 3. Existing Legal Processes, Mechanisms, And Other Programs Relevant In Handling Cases Of Children Involved In The Communist Armed Struggle. The Study's Results Will Contribute To The Existing Data Of The Jjwc On Children In The Context Of Violent Extremism. Consistent With The Ways Forward Of The Phase I Of The Baseline Study, The Result Of The Second Phase Will Serve As Basis In Assessing The Application And Implementation Of Neuchatel Memorandum’s Good Practices Which May Be Adopted By The Philippines. It Will Also Be An Evidence-based Reference In Formulating Policy Reforms, And Programs And Services Aimed At Addressing The Needs Of Children Involved With And/or Affected By The Communist Armed Struggle. More Importantly, It Will Be Used In Drafting The Protocols And Flowcharts For Handling Children Involved In Terrorism, Particularly Those Who Have Been Accused Of Committing Violations Under The Anti-terror Law. Iii. Purpose, Deliverable, And Roles Of The Consultant: We Propose Hiring A Consultant Who Has Extensive Research Experience, Engagement, And Connection With The Communist Insurgent Groups. The Expected Deliverables Of The Consultant Are The Following: 1. Baseline Study Report With Information On A. Number Of Children Who Are Vulnerable (internally Displaced Children) And Exploited By The Communist Insurgency Groups In The Philippines B. Areas (lgus) Where Cases Of Children Exploited/vulnerable To Insurgency Are Prevalent C. Services Provided To Children Exploited Or Affected By Insurgency D. Existing Legal Processes, Mechanisms, And Programs Relevant In Handling Cases Of Children Who Were Exploited By Communist Insurgency Groups (flowcharts, Diagram, Program Model, Etc.) 2. Develop An Inception Report For The Baseline Study (workplan And Research Timeline) 3. Attend Coordination Meetings With Jjwc And The Research Advisory Group (rag) As Regards The Study To Ensure Its Smooth Implementation 4. Coordinate With Research Areas To Ensure Smooth And Secure Data Gathering Throughout The Study. 5. Conduct Interviews/focus Group Discussions With Respondents, If Needed. 6. Keep Jjwc Up To Date With The Developments In The Implementation Of The Study; 7. Present The Initial Results Of The Study To The Research Advisory Group And The Council Members Iv. Qualifications Of Service Provider The Following Set Of Criteria Shall Be Observed In Selecting The Qualified Service Provider: Criteria Percentage • At Least Two (2) Years Of Related Professional Experience In Conducting Baseline Studies And Five (5) Years Of Research Experience (i.e. Research Management, Research Implementation, Etc.); 40% • Education (with Masters Or Doctorate Degree In Social Work, Statistics, Political Sciences And Related Courses) 20% • Skills (proficient In Using Ms Office And Statistical Software Used For Data Analysis And Visualization, Excellent Communication (verbal & Writing) And Analytical Skill;) 20% • Current Workload Relative To Capacity (no More Than Two Ongoing Consultancy Projects With The Government) 20% Total 100% Passing: 85% Additional Qualifications: • Preferably With A Deep Understanding Of The Current Socio-political Condition As Regards The Communist Insurgency In The Philippines. • Preferably With A Background Dealing With Government Agencies And Possesses Knowledge About Terrorism, Child Rights, And The Juvenile Justice Welfare System; • Excellent With Verbal Writing And Analytical Skills; • Willing To Work Under The Direction Of Jjwc, If Necessary; V. Role Of Jjwc • Organize Preparatory Meetings, Consultation Meetings, Including The Presentation Of The Research Design And Report To Jjwc Research Advisory Group (rag) And Council Members; • Assist In Coordinating With The Lgus And Other Government Agencies; • Provide Related Jjwc References And Documents To Assist The Consultant In Crafting The Research Design; • Review And Provide Inputs To Draft And Final Version Of The Baseline Study; • Monitor And Ensure The Timely Accomplishment Of The Deliverables; Vi. Management And Time Period Of The Consultancy The Consultant Shall Report Directly To The Chief Of The Policy And Research Division And Is Expected To Work Closely With The Assigned Jjwc Technical Staff. The Study Will Be Home And Field-based Depending On The Activities Required By The Research Design (data Gathering, Meetings, Etc). The Consultant Is Also Expected To Abide With The Jjwc Child Safeguarding Policy During The Project Duration. The Consultant Will Use Personal Effects And Equipment I.e., Laptop, Mobile Phone, Camera, Data Analysis Software If Any, In Implementing The Project. The Consultant May Also Hire Research Assistants Who Will Be Under His Personal Charge And Supervision. The Consultant's Engagement Shall Take Effect For At Least Six (6) Months From The Issuance Of The Notice To Proceed (ntp). However, The Jjwc Has The Discretion To Extend The Period To Address Challenges And Unforeseen Circumstances, Especially To Ensure The Quality Of The Submitted Baseline Study. Ix. Payment Of Remuneration: The Consultant’s Fee Shall Be The Amount Of The Award Of Contract To The Consultant Inclusive Of Taxes And Charges Which The Government May Impose. The Jjwc Shall Not Be Liable For The Fees Of Research Assistants Or Any Person Who May Be Hired By The Consultant To Assist Him In The Project. Payment Shall Be Made In Tranches As Follows: Amount Schedule Of Release Remarks 20% Of The Contract Price August 2024 Upon Submission Of The Inception Report And Implementation Plan 20% Of The Contract Price September 2024 Upon Submission Of The Research Design And Methodologies 30% Of The Contract Price October 2024 Upon Submission Of The Initial Baseline Study 30% Of The Contract Price November 2024 After Finalization Of The Study In View Of These, The Jjwc Now Invites Interested Consultants To Bid In This Procurement And Submit The Following: 1.
