Description 1. The Department Of National Defense (dnd), Through The Bids And Awards Committee (bac) 1, Intends To Procure Petroleum, Oil, And Lubricants (pol) Requirements For Cy 2024– Lot 1-sub-lot 3 (supply & Delivery Of Ground Petroleum Requirements For Visayas) With An Approved Budget For The Contract (abc) Of Eight Hundred Thirty-four Million One Hundred Forty-five Thousand Five Hundred Twenty-eight And 45/100 Pesos (php834,145,528.45). 2. The Bac 1 Now Invites Technically, Legally, And Financially Capable Suppliers For The Said Project. 3. The Procurement Procedure For This Requirement Is Negotiated Procurement For Two Failed Bidding Pursuant To Section 53.1 Of The Revised Implementing Rules And Regulations (irr) Of Republic Act (ra) No. 9184. The Selection Of The Successful Offer Shall Be Based On The Best And Final Offer That Will Be Submitted On The Set Deadline By The Bac And Which Would Meet The Minimum Technical Specifications Required. 4. Interested Suppliers May Obtain Further Information From The Bac Secretariat At The Address Given Below From June 28, 2024 To July 15, 2024, Monday To Friday, At 8:00am To 5:00pm. 5. The Bac 1 Will Hold A Pre-negotiation On July 02, 2024 At 10:00 A.m. And A Negotiation Meeting On July 16, 2024 At 10:00a.m., Which Shall Be Open To Prospective Offerors. 6. Eight (8) Copies Of The Proposals (one Original And Seven Duplicate Copies) Must Be Submitted To The Bac 1 Which Must Be Duly Received By The Bac Secretariat Through Manual Submission At The Office Address Indicated Below On Or Before 10:00a.m. Of July 16, 2024. Late Submission Shall Not Be Accepted. 7. Interested Offerors Shall Submit Two (2) Separately Sealed And Marked Envelopes. In The First (1st) Sealed Envelope, Marked As Eligibility & Technical Components Are One (1) Original And Seven (7) Duplicate Copies Of Its Eligibility & Technical Documents, As Follows: Envelope 1 – Eligibility And Technical Requirements A Valid Philgeps Registration Certificate (platinum Membership) (all Pages) In Accordance With Section 8.5.2 Of The Irr. For Jv, Each Jv Partner Shall Submit Their Respective Valid Philgeps Registration Certificate (platinum Membership) (all Pages). B Original Of The Duly Signed Statement Of All Ongoing Government And Private Contracts Including Contracts Awarded But Not Yet Started, If Any, Whether Similar Or Not Similar In Nature And Complexity To The Project Under Negotiation. (projects With Notices Of Award Are Considered Ongoing Projects.) C Original Of The Duly Signed Statement Of Completed Single Largest Contract (slcc) Similar To The Project Equivalent To At Least Twenty-five Percent (25%) Of The Abc Of The Sub-lot Participated Into And Completed Within The Last Five (5) Years Prior To The Negotiation. In The Absence Of A Single Largest Contract, The Offeror Should Have Completed At Least Two (2) Similar Contracts And The Aggregate Contract Amounts Should Be Equivalent To At Least 25% Of The Abc Of The Subject Sub-lot And The Largest Of These Similar Contracts Must Be Equivalent To At 12.5% Of The Abc Of The Subject Sub-lot. For This Purpose, Similar Contracts Shall Refer To Supply And Delivery Of Petroleum, Oil And Lubricant Product. Statement Shall Be Supported By: If Slcc Is A Government Contract: A) The Notice Of Award Or Notice To Proceed Or Contract Or Purchase Of Order Issued By The End-user; And B) Certificates Of Completion Or Technical Inspection And Acceptance Committee (tiac) Report. If Slcc Is A Private Contract: A) Contract Or Purchase Order Issued By The End-user; And B) Certificate Of Completion Or End-user’s Acceptance Or Sale Invoices/official Receipts Provided That The Same Expressly State That The Goods Are Received In Good Condition. D Original Of The Duly Signed Nfcc Computation, Or A Committed Line Of Credit From A Local Universal Or Commercial Bank That Must Be At Least Equal To 10% Of The Abc Of The Sub-lot Participated Into. Note: The Nfcc Must Be Sufficient For The Total Of The Abcs Of All The Sub-lots Participated In By The Offeror. E Valid Joint Venture Agreement (jva), In Case The Joint Venture Is Already In Existence, Or Duly Notarized Statements From All Potential Joint Venture Partners Stating That They Will Enter Into And Abide By The Provisions Of The Jva In The Instance That The Bid Is Successful. Failure To Enter A Joint Venture In The Event Of A Contract Award Shall Be A Ground For The Forfeiture Of The Bid Security. In Both Instances, Authority Of The Representative For Each Partner Shall Be Submitted During Bid Opening. In Case Jva Is Not Applicable, The Offeror Must Submit A Statement Stating That Jva Is Not Applicable In Lieu Of The Foregoing. F Original Copy Of Bid Security, Which May Be: I) An Original Copy Of A Duly Notarized Affidavit Of Bid Securing Declaration, Or Ii) Any Of The Following Forms Of Bid Security, In An Amount Not Less Than The Required Percentage Of The Abc Of The Subject Sub-lot In Accordance With The Following Schedule: • Cash, Cashier’s Check/manager’s Check, Bank Draft/guarantee Confirmed By A Universal Or Commercial Bank Equivalent To Two Percent (2%) Of The Abc Of The Sub-lot Participated Into; Or • Bank Draft/guarantee Or Irrevocable Letter Of Credit Issued By A Universal Or Commercial Bank: Provided, However, That It Shall Be Confirmed Or Authenticated By A Universal Or Commercial Bank, If Issued By A Foreign Bank Equivalent To Tow Percent (2%) Of The Abc Of The Sub-lot Participated Into; Or • Surety Bond Callable Upon Demand Issued By A Surety Or Insurance Company Duly Certified By The Insurance Commission As Authorized To Issue Such Security Equivalent To Five Percent (5%) Of The Abc Of The Sub-lot Participated Into. Each Usb Flashdrive Shall Be Enclosed In The Respective Envelope Together With The Physical Copies Of Its Documents. In Case Of Discrepancy Between The Contents Of The Submitted Physical Copies And Scanned Copies Contained In The Usb Flashdrive, The Former Shall Prevail. Moreover, Irregularities (e.g. Unreadable/corrupted Files, Broken/damaged Usb Flashdrive, Discrepancy In The Contents Thereof Vis A Vis The Physical Copies) In The Submitted Usb Flashdrives Shall Not Disqualify An Offeror. 9. This Terms Of Reference Shall Form Part Of The Contract.
