Contract notice: conclusion of a non-exclusive discount agreement according to § 130a para. 8 sgb v for the active substance atorvastatin + ezetimibe, atc c10ba05, for the period 05/01/2022 - 04/30/2024 § 130a paragraph 8 sgb v enables the health insurance companies and pharmaceutical companies to conclude framework discount agreements for the drugs to be dispensed at the expense of the statutory health insurance companies. with regard to the relevant legal regulations for the award of public contracts, a regular process of active substance-related, formal award procedures takes place according to the regulations of the 4th part of the gwb by the dak health. for medicinal products to be specified by the bidder in annex 2 to the contract for the above-mentioned active ingredient atorvastatin + ezetimibe, atc c10ba05, dak-gesundheit intends to conclude drug discount agreements with as many interested pharmaceutical companies as possible before new drug discount agreements come into force. a discount contract i.R.D. admission model to the above active substance comes into force for the first time on 05/01/2022 and ends on 04/30/2024. regardless of this, it ends automatically when the exclusive contract comes into force.The dak-gesundheit assumes that this procedure does not fall within the scope of the cartel procurement law due to the lack of a selection decision and therefore the non-discriminatory access possibility for all pharmaceutical companies. regardless of this, it ends automatically when the exclusive contract for atorvastatin + ezetimibe, atc c10ba05, comes into force as a result of a formal award procedure in accordance with the regulations of part 4 of the gwb with one or more contractual partners. in order to do justice to the variety of potential contractual partners within the framework of the approval model, every pharmaceutical company is able to conclude a framework contract at any time and under the same conditions during the contract period. the contractual documents required for this are available via the online portal www.Dtvp.De/center under i.3. the link mentioned is available for download. the prerequisites for the conclusion or later accession to the contracts, which first come into force on may 1st, 2022, are the complete and timely transmission of the following documents (available for download under the link mentioned under i.3.) to the following department at dak-gesundheit:1. offer letter2. recognition of the contractual provisions of dak-gesundheit, in particular the specified discounts, by submitting the contract with the name or company stamp by the interested party to the designated place.3. the completed annexes 1 and 2 to the contract. the interested party must enter the medicinal products for the above-mentioned active substance here, which are to become the subject of the contract. the documents must be submitted by e-mail to: openhouse@dak.Dedak-gesundheitfachbereich medicinal products (0038 00) nagelsweg 27
