The Supplier Must Be The Exclusive Or Authorized Distributor Of The Principal Company Of The Equipment. Supplier Must Provide Certificate Of Exclusive Distributorship From The Unit Manufacturer Mentioning The Name Of The Philippine Representative. 3. In The Event That The Winning Bidder’s Exclusivity Shall Cease Or Maybe Discontinued Within Five (5) Years From The Perfection Of The Contract, The Winning Bidder Shall Inform And Formally Introduce Clmmrh To The New Exclusive Distributor, Not Later Than 30 Calendar Days. Failure To Comply Shall Be Construed As Breach Of Contract Which Shall Entitle Clmmrh To Any And All Applicable Remedies Provided In Ra 9184 And The Civil Code. 4. The Supplier Shall Provide The Necessary Training Of The Hospital Personnel (end-users & Maintenance Personnel) To Ensure The Smooth And Correct Operations Of The Equipment. 5. The Supplier Must Provide At Least Two (2) Years Full Warranty Which Includes Service And Spare Parts. 6. Parts Should Be Available Within A Period Of Ten (10) Years. Certification Of Manufacturer Guaranteeing The Availability Of All Spare Parts Must Be Presented. 7. Preventive Maintenance And Calibration During Warranty Period Shall Be Scheduled, Performed, And Documented By A Qualified Service Engineer On A Quarterly Basis Or Whenever Necessary Without Cost To The Hospital. Service Performed To Correct System Deficiencies Shall Also Be Documented With The Service Records Maintained In The Project Site. 8. The Supplier Must Provide A Certification To Attest Its Capability For Corrective And Preventive Maintenance Of The Unit. Warranty And Post-warranty Service Shall Be Done By Qualified And Factory-trained Service Engineers Of The Supplier. However, In The Absence Of Trained Service Personnel, A Third Party Service Personnel/ Provider Shall Be Allowed Through A Memorandum Of Agreement; Provided That The Latter Can Provide A Certificate Of Training From The Principal Manufacturer. 9. The Supplier Must Have A Well Trained Service Personnel With Certificate Of Training From The Principal/manufacturer With Corresponding Individual Sss, Phic And Bir, Tax Remittance Duly Notarized And To Be Submitted During Bidding For The Equipment And Its Accessories. However, In The Absence Of Trained Service Personnel, A Third Party Service Personnel/ Provider Shall Be Allowed Through A Memorandum Of Agreement; Provided That The Latter Can Provide A Certificate Of Training From The Principal Manufacturer. 10. The Whole Unit And Its Parts Must Be Brand New. 11. Winning Bidder Shall Insure The Availability Of Consumables In The Market (e.g. Hydrogen Peroxide, Pouch, Biological Indicator, Chemical Indicator Strip And Printer Paper).
